©Isle of Man e business 2008 The Music Industry There is no lack of evidence regarding the challenges that the music industry faces in the areas of unauthorized use of copyright music. The problem is clear but the solution is less clear and is one that has taxed the minds of the music industry.

©Isle of Man e business 2008 The Music Industry Because of its unique position, the Isle of Man believes that it can offer real advantages to the music industry at a time of difficulty and uncertainty, particularly regarding the monetization of downloads. The Island has the following advantages:

©Isle of Man e business 2008 The Music Industry Constitutional position Uniquely, compared to its competitors, the Isle of Man is already party to: The Patent Cooperation Treaty The European Patent Convention The Madrid Protocol WIPO and TRIPS

©Isle of Man e business 2008 The Music Industry Telecommunications The Isle of Man has been used as a test bed for new telecoms technology for most of the last 10 years. The Isle of Man: Was one of the first jurisdictions in Europe to roll out ADSL Was second in the world to have 3G Was first in the world to have 3.5G Will be the first in the world to have a fully functional next generation telephone network delivering digital TV

©Isle of Man e business 2008 The Music Industry The Team DCIA Tag Strategic Peter Jenner Ian Pennman (New Media Law)

©Isle of Man e business 2008 The Music Industry It is proposed that we present the idea of licensing telcos and ISPs on the Island to enable their subscribers to access music including P2P for non commercial use via fixed line broadband or their mobile devices for a blanket monthly fee.

©Isle of Man e business 2008 The Music Industry Through the ISPs and telcos there lies the ability to offer a granular approach that gives the ability to know who is accessing what and therefore creating a fair and more accurate way of sharing the revenue. This would not mean that existing commercial services became free but it might effect their business models. Added value propositions and customer preference and loyalty are always a consideration.

©Isle of Man e business 2008 The Music Industry Meetings with key influencers and stake holders An open dialog with labels and rights holders and get buy in for our proposal Fine tune the proposal following dialogue and feedback with industry. Get commitment from one or more labels/rights holders to visit the Isle of Man to develop the proposition further Crystallize the Isle of Man offering Communicate the package to the industry
