3. NISPOM Chapter 6 – Visits and Meetings 6-201 Government Sponsorship of Meetings- a “Meeting” (i.e. classified visit) must be authorized by a government agency; a. Request for authorization-Contractors desiring meetings shall submit their request to the Government agency, the request shall include: 1. An explanation of purpose 2. Subject matter 3. Dates and location 4. General content o b. Location- classified sessions shall be held at Federal Govt installations or cleared contractor facilities; c. Security Arrangements for meetings- The contractor shall develop the security measures and procedures to be used 1) Announcements- Approval of the authorizing agency 2) Clearance and Need to Know- All in attendance shall possess the requisite clearance and need-to- know 3) Presentations- Classified information must be authorized for disclosure in advance by the government agency having jurisdiction over the information 4) Physical security- Measures shall be designated for control of the information ©2007 SCRA®. NISPOM Chapter 6 – Visits and Meetings 6-202 Disclosure authority at meetings a) Obtain prior written b) Furnish copy of authorization to the government sponsor of the the meeting c) Associations are not responsible for disclosure; authority to disclosure classified information at meetings must be granted by the government agency 6-203 Request to attend classified meeting- Before a contractor can attend a classified meeting the contractor shall provide justification

NISPOM Chapter 7- Subcontracting Section 1: Prime Contractor responsibilities 7-100 General- Chapter outlines responsibilities of Prime contractor 7-101 Responsibilities- before a prime contractor may release information to a subcontractor the following actions are required: A. Determine the security requirements of the contract 1) Access to classified required: Classified contract is established; subcontractor must have appropriate FCL and safeguarding capability a) If access is not required during pre-award phase: prospective subcontractors are not required to possess an FCL to receive or bid on the solicitation b) Access required during pre-award phase, all prospective subs must have FCL 2) Access to classified not required: No classified contract; If the prime contract contains requirements for release or disclosure of certain information (such as Sensitive But Unclassified information), the requirements shall be incorporated in the solicitation and the subcontract B. Determine the clearance status of prospective subcontractors 1) Prospective subcontractors have appropriate clearances 2) Prospective subcontractors do not have appropriate clearances ©2007 SCRA®. 6. NISPOM Chapter 7- Subcontracting C. Requesting contractors shall allow lead time; If sufficient time cannot be allotted then the CSA will continue the FCL to allow the sub to quality for future consideration if: 1. The delay was not caused by lack of cooperation by the sub 2. Future classified negotiations may occur in 12 months 3. Reasonable likelihood that sub will be awarded a subcontract 7-102 Security Classification Guidance-Prime contractors shall ensure that a 254 is in every subcontract; a) An original 254 shall be included in each Request For Quotation, Request For Proposal, or Invitation for Bid to ensure that prospection subcontractor is aware of the security requirements of the subcontract; An original 254 shall also be included in the subcontract awarded to the successful bidder b) A revised 254 shall be issued as necessary c) Requests for public release by a subcontractor shall be forwarded through the prime contractor to the GCA ©2007 SCRA®. NISPOM Chapter 7- Subcontracting 7-103 Completion of the subcontract- Upon completion of the subcontract, the subcontractor may retain classified material received or generated under the subcontract for a 2 year period, provided the prime contractor or GCA does not advise to the contrary. If retention is required beyond the 2 year period, the subcontractor must request written retention authority thru the prime to the GCA; If approved by the GCA the prime will issue a final 254 annotated to provide the retention period and final disposition instructions 7-104 Notification of Unsatisfactory conditions – The prime shall be notified if the CSA discovers unsatisfactory security conditions in a sub’s facility ©2007 SCRA®.
