13. Radio Rebanding August 2004 - FCC releases order to solve public safety radio interference FCC appointed “Transition Administrator” to manage process and mediate disputes. FCC Report and Order allows for “Comparable Facilities” - Licensees receive no gains in features/product. The 3 R’s rule: Retune, Reprogram, Replace. Sprint-Nextel responsible for all costs All expenses heavily scrutinized, detailed justifications required.

Radio Rebanding September 2006 - Orange County issues RFP/signs agreements; Televate - Engineering Services Shulman, Rogers, Gandal, Pordy & Ecker P.A – Legal Counsel May 2007 - Planning Agreement signed with Sprint/Nextel and the Transition Administrator June 2007 - Signed Interlocal Agreements with Municipalities/Agencies for reimbursement

Rebanding - Next Steps Motorola Assessment of OC system due Apr 15, 2008 (60 days for Televate to review) OC to submit cost estimate to Sprint-Nextel Jun 13, 2008 (30 days to negotiate, then mediation) Shulman, Rogers, Gandal, Pordy & Ecker P.A filed Rebanding extension with FCC for Region including Orange County
