2 SSP SECRETARÍA DE SEGURIDAD PÚBLICA 2 Mexico is embarking on a deep reform of its Penitentiary System. Last June, Congress approved a constitutional reform that transforms the goals of the Penitentiary System and provide it with new tools to reach them. INTRODUCTION The judicial reform established the rehabilitation of offenders as the central goal of the Penitentiary System. Article 18: The penitentiary system shall be organized on the basis of labor, job-training, education, health and sports as means to achieve the reintegration of the sentenced individual to society and seek to avoid them committing further crimes (…) In Mexico, rehabilitation of offenders has been difficult to achieve. One of the main obstacles has been the overcrowding of prisons.

4 SSP SECRETARÍA DE SEGURIDAD PÚBLICA 4 Only 11 of these are exclusively for female inmates. INTRODUCTION The Mexican Penitentiary System is made up of 441 prisons. National total capacity is 167,281 prison beds. The national total population is 218,030 inmates. There is a deficit of 50,749 beds and 32% overcrowding. State and municipal prisons concentrate 98.2% of the penitentiary population. The 6 federal centers house 1.8% of the total population. Data: June 2008

5 SSP SECRETARÍA DE SEGURIDAD PÚBLICA 5 Incorporate the use of alternative sentences to imprisonment. Curb the growth of inmate population by resorting to alternative sentences. STRATEGY The recently approved reforms will allow the Mexican Penitentiary System to: Align the system with United Nations Rule 58 : The purpose and justification of a sentence of imprisonment or a similar measure deprivative of liberty is ultimately to protect society against crime. This end can only be achieved if the period of imprisonment is used to ensure, so far as possible, that upon his return to society the offender is not only willing but able to lead a law-abiding and self-supporting life.

6 SSP SECRETARÍA DE SEGURIDAD PÚBLICA 6 Respond to overcrowding by building new penitentiary centers focused on rehabilitation. STRATEGY Articulate social rehabilitation programs for inmates.

7 SSP SECRETARÍA DE SEGURIDAD PÚBLICA 7 MISSION STATEMENT Protect society from crime by confining those who harm it in controlled environments that are safe, humane, efficient and self- sustainable. Provide peace to the people. Generate social rehabilitation conditions based on work, job-training, education, health and fitness. Help offenders regain their freedom as useful citizens, to both themselves and society, respectful of the law and public order.
