2 INTERSTATE RECIPROCAL OVERPAYMENT RECOVERY ARRANGEMENT
An agreement where participating states shall act as Agents for each other in a reciprocal arrangement for recovery of overpayments of benefits. These overpayments are recovered by means of offsetting. Current benefits are retained and applied when claimed toward the outstanding balance of the overpayment. Florida became a member of IRORA in February 2007.

4 DUTIES OF THE REQUESTING STATE
The requesting state must send the recovering state a written request for overpayment recovery assistance which includes: Certification that the overpayment is legally collectable under the requesting state’s law. Certification that the determination is final and that any rights to postponement of recoupment have been exhausted or expired. A statement as to whether the State is a member of IRORA. Copy of the initial overpayment determination and a statement of the outstanding balance. The requesting state must send the recovering state a new outstanding overpayment balance whenever their state receives a payment from a source other than the recovering State. The requesting state must also send notification to the claimant that they are requesting assistance from the other state in the recovery of the overpayment.

5 DUTIES OF THE RECOVERING STATE
The recovering state shall issue the overpayment recovery determination which includes: The date of the original overpayment determination. The name of the state requesting recoupment. Type of overpayment (fraud or non-fraud). Program type of overpayment. The state must also provide the claimant the right to request redetermination and appeal of the determination to recover the overpayment by offset. The request must include: Date of the original overpayment. Total amount to be offset. Weekly offset amount.

10 INTERSTATE ARRANGEMENT FOR COMBINING EMPLOYMENT AND WAGES
This agreement is separate from IRORA. If an overpayment results from a combined wage claim it is mandatory that all states collect (offset) on behalf of the other state regardless of IRORA membership.

11 RIGHTS AND RESPONSIBILITIES OF THE PAYING STATE
A paying state must honor any transferring state’s overpayment recovery request, unless its law prohibits such recovery. The transferring state must certify the following: The overpayment determination was issued not more than three years prior to the effective date of the combined-wage claim. The overpayment determination is final. Repayment of the overpayment is legally required and enforceable under the law of the transferring state. If there are two transferring states requesting recovery of an overpayment, the amount recovered shall be divided in proportion to the wages each State contributed to the monetary determination.

12 RECOV ERY OF OVERPAYMENT RESULTING FROM THE CANCELLATION OF A COMBINED-WAGE CLAIM
If any benefits have been paid on a combined-wage claim, a condition for withdrawal is the claimant’s agreement to reimburse the paying state. Florida requires the claimant to signed a copy of the UCB-71. Once this is received the Florida claim is cancelled and the overpayment is established. When the appeal rights have expired Florida sends a request to the paying state for their assistance with the recovery of the overpayment. Overpayments resulting from the cancellation of a prior combined wage claim takes priority over any other type of overpayment.

15 RIGHTS AND RESPONSIBILITIES OF THE PAYING STATE
The paying state must offset an outstanding overpayment in a transferring State prior to honoring a request from any other state under any interstate or cross program agreement. The paying state should recover overpayments in the following order: Overpayment of benefits resulting from the cancellation of a combined wage claim. Overpayment of benefits, State or Federal, under the paying State’s law. Overpayment of benefits under a transferring State’s law. Overpayment of benefits paid by another State.
