3 Second Generation Anticoagulant Rodenticides Second Generation Anticoagulant Rodenticides (SGARs) regulations took effect July 1, 2014. Sellers of SGARs must now be licensed as Pest Control Dealers. Product Compliance Branch staff continue to distribute informational flyers during Marketplace Surveillance Inspections to retailers during inspections.

4 DPR has determined that the VOC trigger level was likely exceeded in 2013, so the non-fumigant high-VOC prohibitions will go into effect in May-October 2015. San Joaquin Valley Non-Attainment Area

5 Trigger for high-VOC prohibitions 3 CCR 6452.2(f)) –SIP goal –Trigger Pesticide VOC emissions are based on pesticide use report (PUR) data and product VOC content data 2013 PUR data indicates that the high-VOC prohibitions are triggered for 2015 and will be in place for at least 2 years

8 Chlorpyrifos (Worker Health and Safety) –Due to human health and environmental (surface water) concerns –Proposed Regulation September 26, 2014 –Restricted Material, when used for the production of an agricultural commodity –Affects 30 products –Comment period ends November 12, 2014

9 Rulemaking Chlorpyrifos –Applications must be made or supervised by a certified applicator. –Purchase, possession, or use requires the property operator to obtain a permit from the county agricultural commissioner. –Businesses require a recommendation from a DPR licensed pest control adviser. 10 Rulemaking Closed System (Enforcement Branch) –Tiered mitigation scheme to establish specific closed mixing system and personal protective equipment requirements –Based on a pesticide label's Human Hazards and Precautionary Statements. –Anticipate noticing the proposed regulation for public comment by the end of the year.

11 Rulemaking Personal Protective Equipment - Eye and Hand Protection (Enforcement Branch) –Clarifies PPE requirements –Consistent with a nationally recognized consensus standard –Hand protection requirements will be in alignment with U.S. EPA guidelines. –Anticipate noticing the proposed regulation for public comment by the end of the year.

12 Rulemaking Research Authorization Regulations (Registration Branch) –DPR plans to include in this proposal a requirement to submit a 72-hour Notice of Intent to County Agricultural Commissioners. –Outreach to solicit input from County Agricultural Commissioners is planned for later this year.

13 Rulemaking Chloropicrin Mitigation Proposal Community and Technical Meetings (Worker Health and Safety) Reduce risk from acute (short-term) exposures that might occur near fields fumigated with products containing chloropicrin. The deadline for comments was August 31, 2013. WH&S received many letters and emails and are grouping similar comments for assessment and response. 15 Maintenance Gardeners PML Is performing a Licensing Survey of all CAC offices regarding their thoughts on MG issues. Particularly the value to be gained by moving the exam process to the county level. 41 counties have responded so far and a summary should be available shortly.

17 Training Investigative Techniques Training: DPR’s Enforcement Branch and Worker Health & Safety Branch will be providing a joint one-day intermediate level Investigative Techniques Training course for County Agricultural Commissioner (CAC) inspectors. Please refer to ENF 14-18 for details including training dates and locations.

18 Training Hearing Officer Training: CACASA contract hearing officers and CAC staff soon-to-be hearing officers will be trained at four locations statewide. The first Hearing Officer Training was held in Redding on October 16 and 17.

19 Training Ag/Urban Workshops: The Enforcement Branch partnered with UC Davis to present Neighbors at the Edge. These two-day workshops were directed towards County Agricultural Commissioners, their staff, and other invited guests. Focused on resolving agricultural land and urban development conflicts, and building collaborative relationships with local governments, the community, and the media.
