2 NPSPAC Regional Planning Background  National Plan is contained in the Report and Order, General Docket No. 87-112.  FCC set national guidelines for the use of spectrum, “while allowing RPCs to develop plans tailored to their own areas and communications needs.” National Plan Report and Order at 905.  47 C.F.R. § 90.16

3 Rebanding Amendments Public Notice, DA 09-212 (rel. 2/10/2009)  All RPCs for non-border NPSPAC Regions must file Amended Plans or Notifications by April 13, 2009 RPCs in Waves 1, 2 and 3 must amend plans reflecting the 15 megahertz shift combined with other substantive amendments to reflect the 15 megahertz shift in the NPSPAC band from 821- 824/866-869 MHz to 806-809/851-854 MHz Notification of intent to file combined rebanding and with other modifications, e.g.,  Disposition of NPSPAC channels within the region.  Technical procedures  Procedures for Assigning Channels

4 Plan Amendment STREAMLINED Process:  Amendment consists of Table of Allotments for 806- 809/851-854 MHz channels (and minor administrative updates)  Deadline April 13, 2009  Cover letter signed by RPC Chair  Reference RPC Docket No. (PR or Gen.)  No adjacent region coordination required  June 2009 - Bureau approves 30 RPC Streamlined Amendments

5 In summary,  (30) Approved Streamlined Plan Amendments Pending Approvals (Regions 19, 34 and 47)  (4) Pending defective submissions pending. RPCs contacted (Regions 4,12, 25 and 41), awaiting Table of Allotments.  (2) Awaiting receipt of late-filed non-Streamlined Amendment (Region 28)  (4) Non-Streamlined Amendments reviewed and ready for Comment PN (Regions 6, 9, 22 and 24)  (1) No response rec'd (Region 48 U.S. Virgin Islands)

6 Standard Plan Amendment and Process  Cover Letter must summarize changes reflected in the Plan Amendment  Addressed to Secretary FCC, Attn: Acting Chief, PSHSB, reference WT Docket No. 02-55 and RPC Docket No. ___. OR – under 700 MHz PS Docket No. 06-229 and WT Docket No. 02-378  Amendments must include evidence of Adjacent Region Coordination  Must be filed in both dockets  Recommend filing using Commission’s Electronic Comment Filing System (ECFS).

8 Plan Amendment Review Process  Plan Amendments are reviewed --  If accepted, placed on public notice for comment (20 days for comments, 10 days for replies).  All comments are considered.  Applies to both Plan and Plan Amendment submissions  Rejected Plan Amendments –  Notify RPC Chair of discrepancy, where possible, resolve issues on a staff to staff basis.  Letter to RPC rejecting plan -

9 RPC Obligations  Administrative management of spectrum resources requires fair and open procedures  Transparency of RPC process  All plans include a description of how to apply for channels  Applications, supporting evidence, readiness, evaluation criteria, scoring of applications.  Communications with applicant and RPC membership.

13 Electronic Comment Filing System ECFS Can I file one comment to multiple proceedings? If the Public Notice requests that you file comments to more than one proceeding, you will need to file separate comments for each proceeding that is listed in the Public Notice. Can I attach multiple documents to the same comment? Yes. After attaching the first document, the system will navigate to another web page whereby you would click the button labeled "Enter Additional Attachments" and attach the second document. Continue in this fashion until you have attached all the documents. You can only attach one document at a time.
