2 ATS Environmental 2009 42 Culverts and fords (1) Notwithstanding regulation 41(2)(d) of these regulations, no person shall construct any culvert or ford in any natural river, stream, or water in such a way that the passage of fish would be impeded, without the written approval of the Director-General incorporating such conditions as the Director- General thinks appropriate. Freshwater Fisheries Regulations 1983

3 ATS Environmental 2009 Given the strength and the intent of the fisheries regulations concerning obstructions to fish passage, it is alarming that, since 1985, many thousands of structures do not comply.

4 ATS Environmental 2009 Most authoritative bodies have policies to remove obstructions to fish passage however high costs have generally prevented implementation

5 ATS Environmental 2009 Typical Model In anticipation of high costs only “high value” habitats are targeted Before & After studies are usually commissioned to justify the expenditure Consultants and/or Engineers engaged to design specific solution Consent process – adds an extra layer of cost Tender Process – adds further cost

ATS Consulting is working in conjunction with NIWA, Regional Councils and other agencies to develop affordable solutions to remedy obstructions to fish passage.
