1 Awareness & Prevention Presented by Traci Terrill ESC Region XV ~ Back to School Conference 2011

2 Changes in the Law - HB1942 Allows a school district to include procedures in its staff development relating to preventing, identifying, responding to, and reporting incidents of bullying. Defines bullying as engaging in written or verbal expression, expression through electronic means, or physical conduct that occurs on school property, at a school‐sponsored or school‐related activity, or in a vehicle operated by the district and that has the effect or will have the effect of physically harming a student, damaging a student’s property, or placing a student in reasonable fear of harm to the student’s person or of damage to the student’s property; or is sufficiently severe, persistent, and pervasive enough that the action or threat creates an intimidating, threatening, or abusive educational environment for a student. 3 Changes in the Law – SB407 Meant to prevent and hold minors responsible for transmitting sexually explicit messages by establishing educational programs for violators. "Sexting" between minors has historically been categorized as pornography, which means violators face felony convictions and possible registration for life in the Texas Sex Offender Registration program. Previously, anyone found sending or receiving sexts would be viewed by the law as possessing or trafficking pornography. The new law will grant exemption from punishment for those who receive a sext and either report or destroy it within 48 hours. 13 What is Cyberbullying? "Cyberbullying" is when a child, preteen or teen is tormented, threatened, harassed, humiliated, embarrassed or otherwise targeted by another child, preteen or teen using the Internet, interactive and digital technologies or mobile phones. It has to have a minor on both sides, or at least have been instigated by a minor against another minor. Once adults become involved, it is plain and simple cyber-harassment or cyberstalking. Adult cyber-harassment or cyberstalking is NEVER called cyberbullying. Start the Talk Start the Talk
