1 Goran Jovanovski Director – State Labor Inspectorate Repablic of Macedonia 23-24 November, Lisbon Needs and challenges in the field of occupational safety in the Republic of Macedonia. In accordance with the determined plan and dynamics in the field of occupational safety and health, the State Labor Inspectorate of the Republic of Macedonia has continued with the realization of the activities regarding the harmonization of the national legislation, namely transposing the EC directives from this domain.

2 Transposed directives during 2009 Council Directive 83/477/EEC of 19 September 1983 on the protection of workers from the risks related to exposure to asbestos at work (second individual Directive within the meaning of Article 8 of Directive 80/1107/EEC); Council Directive 91/382/EEC of 25 June 1991 amending Directive 83/477/EEC; and theDirective 2003/18/EC of the European parliament and of the Council of 27 March 2003 amending Council Directive 83/477/EEC. Directive 1999/92/EC of the European Parliament and of the Council on Minimum Requirements for Improving the Safety and Health Protection of Workers Potentially at Risk from Explosive Atmospheres (15th Individual Directive within the Meaning of Article 16(1) of Directive 89/391/EEC)

3 Planned until the end of 2009 The Slovenian experts, with expert support within the TAIEX instrument, shall assist the preparation of the Rulebook on the protection and health safety of the workers regarding chemical substances, where the following shall be transposed Council Directive 98/24/EC of 7 April 1998 and 2000/39/ЕС on the protection of the health and safety of workers from the risks related to chemical agents at work (14th individual Directive within the meaning of Article 16(1) of Directive 89/391/EEC) and Directive 91/322/EEC on establishing indicative limit values for chemical, physical and biological agents at places of work;

4 Envisaged to be transposed during 2010 Directive 2004/37/EC of the European Parliament and of the Council of 29 April 2004 on the protection of workers from the risks related to exposure to carcinogens or mutagens at work (Sixth individual Directive within the meaning of Article 16(1) of Council Directive 89/391/EEC); Directive 2000/54/EC of the European Parliament and of the Council of 18 September 2000 on the protection of workers from risks related to exposure to biological agents at work (seventh individual directive within the meaning of Article 16(1) of Directive 89/391/EEC);

5 Envisaged to be transposed during 2011 - Council Directive 92/85/EEC (tenth individual Directive) for pregnant workers and workers who have recently given birth or are breastfeeding; Council Directive 92/91/EEC of 3 November 1992 concerning the minimum requirements for improving the safety and health protection of workers in the mineral- extracting industries through drilling (eleventh individual Directive within the meaning of Article 16 (1) of Directive 89/391/EEC); Council Directive 2004/40/EC (18th individual Directive) on the minimum health and safety requirements regarding exposure of workers to the risks arising from physical agents (electromagnetic fields);

6 Envisaged to be transposed during 2012 Council Directive 92/104/EEC of 3 December 1992 on the minimum requirements for improving the safety and health protection of workers in surface and underground mineral-extracting industries (twelfth individual Directive within the meaning of Article 16 (1) of Directive 89/391/EEC) ; Council Directive 93/103/EC of 23 November 1993 concerning the minimum safety and health requirements for work on board fishing vessels (thirteenth individual Directive within the meaning of Article 16 (1) of Directive 89/391/EEC) ; Council Directive 2006/25/EC (19th individual Directive) on the minimum health and safety requirements regarding the exposure of workers to risks arising from physical agents (artificial optical radiation);

7 TRAININGS During September, a two-day seminar was held on the subject of introduction with the dilemmas regarding the acts and the regulations in the field of Misdemeanor Law, concerning the misdemeanor proceedings before the Misdemeanor Body. University professors and representatives from the Academy for Training of Judges of the Republic of Macedonia were lecturers on this subject.

8 TRAININGS From 05.10 - 09.10 (2009) a training was conducted with 22 labor inspectors on risk assessment organized by ILO attended by two (2) experts, from which, one from the Institute for Occupational Safety and Health of Great Britain and one expert form the International Training Centre of the ILO from Turin- Italy

9 TRAININGS At the beginning of the November, a two-day training was held with the Expert mission from France on the implementation of the Council Directive 83/477/EEC of 19 September 1983 on the protection of workers from the risks related to exposure to asbestos at work (second individual Directive within the meaning of Article 8 of Directive 80/1107/EEC)

10 Training and web application During the November and December 2009, two-day seminars are being held on the subject of Human trafficking and Labor exploitation, organized by the OSCE Mission throughout four regions of the country. On 20 and 21 November ILO has organized a two-day seminar on the subject of Inspection supervision in the field of labor and the experience of the inspection supervision from Spain. On 11 December, a one-day seminar shall be organized by ILO with the Labor inspection on the subject: introduction with certain international conventions of ILO in the field of labor Currently a software is designed to satisfy the need of the SLI which represents a web application connected with many institutions, in in order to enable data transfer, and also building a stronger database

11 Printed brochures Relating the provisions of the Law on Occupational Safety and Health, 60 thousand brochures were printed and distributed to the employers. By the end of 2009, all adopted, i.e. published rulebooks shall be printed and distributed to the employers.

12 Technical assistance Republic of Macedonia has an objective to introduce integrated inspection supervision. Technical assistance relating the previous, namely experiences of the member states which have completed this phase. Cooperation relating the amendment of the transposed Directives (practical application of these bylaws)

13 Technical assistance The Government of the Republic of Macedonia established the Council for Occupational Safety and Health, During 2010, the Government of the Republic of Macedonia shall adopt the Program for Occupational Safety and Health Exchange of experience regarding the program content, Manner of drafting the strategic opinions concerning the implementation of the program.

14 Commenced cooperation programs The Republic of Macedonia has signed a Program for Cooperation with the Republic of France for the period 2009-2011. Activities: The Project aims to provide support for the transposition of the two Directives in the field of occupational safety and health in the national legislation: Directive 2004/37/EC on the protection of workers from the risks related to exposure to carcinogens or mutagens at work; Council Directive 2004/40/EC on the minimum health and safety requirements regarding exposure of workers to the risks arising from physical agents (electromagnetic fields).
