1 An Update on ESEA, Waivers, Impact on SES, Future Opportunities Education Industry Association: Legislative Update

2 ESEA Reauthorization Senate HELP Just Voted Bi-Partisan Bill-light on Federal Intervention and No SES. Sen. McCain Introduced Bill to Fix and Save Tutoring. Companion Bill Coming in House. Both Are Important /Symbolic for Now, but are Important Signals to States For Waivers. Appropriations Bills (CR) May Be Used to Void Conditional Waivers and/or Protect SES as Parental Participation Provision that is Exempted from Waivers.

3 Waiver “101” Sec’y Duncan Invited States to Seek Flexibility in Conditional on Accepting Fed’l ed reform priorities: 1.New College/Career Readiness Standard and Tests, 2.Differentiated Accountability/Support Systems (identifies Reward, Priority and Focus Schools) 3.Mandated Interventions for Worst Schools (School Turnaround Models), and 4.Teacher Evaluations Tied to Student Achievement 39 States Signaled Intentions to Apply-RTTT States are Most Ready to Apply Impacts 2012-13 School Year at Earliest

Policies Follow USDE Blue-Print for ESEA Reauthorization Multiple Areas of NCLB May be Waived-State May Select One or More: 1.Change AYP standards for 2014 2.Relax Mandated Use of SES/Choice 3.Rural Programs 4.School-wide Title I 5.Use SIG for Priority and Focus Schools 6.Reward Schools 7.Relief from HQT Requirements 8.Flexibility to Transfer Funds 9.Use 21 st CLC During School Day States Could Request Freeze to AYP at 2011-12 levels if they need more time to prepare waiver application

5 Impacts on Your SES Business States Could Opt Out of SES –All or Partially, or… States Could Implement New Tutoring Interventions that Fix Past Problems: 1.Tougher Standards for Provider Approval and Closer Alignment to Classroom 2.More Control at LEA Level-contracting and selection 3.Competitive Grants at State Level for Voluntary Tutoring, or 4.Mandated at Focus and Priority Schools 5.Improved Accountability and Impact Studies 6.Admin $$ for SEAs and LEAs 7.Other Provisions TBD

6 SEAs Applying by Nov. 14 Colorado, Florida, Georgia, Indiana, Kentucky, Massachusetts, Michigan, Minnesota, Mississippi, New Jersey, New Mexico, North Carolina, North Dakota, Oklahoma, Tennessee, Vermont and Wisconsin.

7 States Applying in 2012 Arkansas, Arizona, the District of Columbia, Delaware, Hawaii, Idaho, Illinois, Iowa, Kansas, Maine, Maryland, Missouri, Nevada, New Hampshire, Ohio, Puerto Rico, Rhode Island, South Carolina, South Dakota, Utah, Virginia, and Washington, Plus Arizona, Utah, New York, CT, and OR

8 States Not (Yet) Applying Alabama, Alaska, California, Louisiana, Montana, Nebraska, Pennsylvania, Texas, West Virginia, and Wyoming.

9 Waiver Process Apply by Nov. 14 th, Feb. 2012 and May, 2012 External Review Panel With Guidance by USDE Staff. “Rolling Admissions” with Great Effort to Accept Applications. Requires Broad Consultation at State Level— This is Your Best Opportunity to Influence Applications.
