1 Revised ADC Regulations New text in italics and blue § 20685.Beneficial Reuse.

2 Revised ADC Regulations Waste materials used as ADC that already meet the grain-size specifications for the appropriate material need not be processed if the EA determines that the material as received at the landfill is adequate to perform the functions of daily cover and meets the appropriate specifications.

3 Revised ADC Regulations (8) Compost, co-compost, and chemically fixed sewage sludge and water treatment sludge only, that meet the performance standards for cover material, shall be limited to up to 25 percent% of landfill cover materials or landfill cover extenders as required under Public Resources Code (PRC) 42245

4 Revised ADC Regulations All types of ADC still must be approved by the EA in writing prior to use at solid waste landfills.

5 Revised ADC Regulations (B) Green material used for alternative daily cover shall be processed prior to being applied to the working face unless the green material to be used as alternative daily cover already meets the grain size specifications.

6 Revised ADC Regulations 11) Spray applied Cementitious products (A) Such products shall not be applied when there is a local forecast of greater than 40% chance of precipitation within 8 hours of application time in the vicinity of the landfill.

7 Revised ADC Regulations Prior to spreading and compacting on the working face, these materials shall comply with a grain size specification by volume of 95% less than 12 inches and 50% less than 6 inches as determined by the EA. The CIWMB shall provide technical assistance in making this determination if requested by the EA.

8 Revised ADC Regulations (B) Alternative Daily Cover and Beneficial Reuse— Describe alternative daily cover and beneficial reuse waste types, quantities, processing methods, alternative processing or grain size specifications if applicable, operations methods, and applicable engineering, industry guidelines, or other standard practices that will be used to ensure compliance with §§20685 and 20690.

9 Revised ADC Regulations Should the CIWMB determine after consulting with the EA that an owner or operator violated this standard, the owner or operator shall revise the applicable reports to reflect the overuse as disposal, and pay the required Board of Equalization (BOE) disposal tipping fees for the amount of overuse. EAs shall not be responsible for making such determinations.

10 Revised ADC Regulations Materials accepted at the landfill to be used as alternative daily cover or for beneficial reuse shall be weighed upon receipt but need not be weighed again prior to placement at the landfill. Appropriate conversion factors for specific materials based on industry standards are acceptable for tracking the use of the materials after acceptance at the gate.

11 Revised ADC Regulations Calculate the estimated range in tons of these materials that are anticipated to be used based on waste types, etc.

12 Revised ADC Regulations The owner or operator shall not continuously use alternative daily cover for a period of more than one month without the application of soil as daily cover over the entire active area, unless an alternative period is approved by the EA with concurrence by the CIWMB.

13 Revised ADC Regulations – Section 20690(a)(4) Board staff feel that an open ended entitlement to use ADC at all times is in partial conflict with this existing regulation – namely that LFs which are not open on every day - Closed for a period of >24 hours - must cover with soil for that period; Board staff and LEAs have had compliance issues with, and resistance from, some operators who have not felt obligated to meet this standard – for example, even though a LF is not open for waste disposal on a Sunday, operations at such LFs may be continuous leading the operators to contend that they need not cover with soil even though the regulation is clear that they must.

14 Revised ADC Regulations Section 20690(a)(4) There currently is no language in the regulations which prevent operators from using ADC on a continuous basis; Board staff feel it is reasonable to expect that LF operators can ensure that they completely cover their sites with soil once per month. Although most large scale operators are clear on how to run a landfill, regulations are usually written to cover the sites that don’t always use best management practices. Alternatives remain in place if the EA is satisfied that using ADC on all days a LF is open is maintaining adequate compliance with SMS.
