2 TOM TORLAKSON State Superintendent of Public Instruction Session Goals Participants will  Understand the requirement of the LEA Plan and the Annual Update  Know the required content of an LEA Plan and the Annual Update  Know how to submit the LEA Plan or Annual Update for continued funding 2

3 TOM TORLAKSON State Superintendent of Public Instruction LEA Plan Requirement  Per Title III, section 3114: for a fiscal year, eligible LEAs must have a plan in accordance with Title III section 3116 to receive Title III Funding (LEP & Immigrant) 3

4 TOM TORLAKSON State Superintendent of Public Instruction Annual LEA Plan Update  LEAs who participate in the Title III, LEP or Title III, Immigrant programs are required to update their LEA Plans annually (ESEA, Title III, Part A, Section 3114)  The annual LEA Plan update must include a budget. 4

5 TOM TORLAKSON State Superintendent of Public Instruction Annual LEA Plan Update (Cont.)  As part of the CARS “Certificate of Assurance” page, the CDE requires LEAs to provide a direct link (URL) to their posted updated LEA Plan with annual budget  CDE staff will confirm that the updated plans with budgets are posted at the URL provided before releasing any funds to LEA in 2015-16 5

7 TOM TORLAKSON State Superintendent of Public Instruction LEA Plan Update  For Fiscal year 2014-15 LEAs were requested to provide in CARS the URL where their LEA plan with program budget is located  Many LEAs did not provide the requested/required LEA Plan update information  Therefore, we are providing more information and technical assistance to ensure the LEA meets the requirement 7

8 TOM TORLAKSON State Superintendent of Public Instruction LEA Plan Update (cont.)  The LEA may use LEA Plan Performance Goal 2 template with budget columns (See attached sample one) for the required annual program and budget updates.  Please note, if LEA uses Goal 2 template without budget columns, Title III Annual Budget must be attached  The Annual Budget would be for the subgrant year 8

10 TOM TORLAKSON State Superintendent of Public Instruction LEA Plan Update (cont.)  The CDE has developed a sample “Title III Budget Overview for the Annual Update”  The template may be used as the annual update  It becomes an addendum to the multi- year LEA Plan (see attached sample two) 10

12 TOM TORLAKSON State Superintendent of Public Instruction LEA Plan Update (cont.)  This template is not designed to be used in lieu of an LEA plan, but as an update to Goal 2 of the LEA Plan.  It addresses only the annual update of budget and activities for Title III when all information is included,  It does not satisfy or replace the required Title III Year 2 or Year 4 Improvement Plan  Activities identified in the LEA annual budget must demonstrate that the funding is used to supplement the level of other federal, state, and local public funds 12

13 TOM TORLAKSON State Superintendent of Public Instruction LEA Plan Update  The LEA must  provide an update of the goals and activities  must identify the required and allowable activities to be implemented with Title III funds  The LEA Plan must identify all items to be purchased in support of the activity in the Title III plan.  This would include personnel, materials, programs and services consistent with the required and allowable activities of Title III, and  are supplemental to other state, federal, and local funds 13

14 TOM TORLAKSON State Superintendent of Public Instruction LEA Plan Update  The LEA Plan must identify the budgeted amounts for each activity identified to sufficiently implement the action to meet the LEA goals 14

15 TOM TORLAKSON State Superintendent of Public Instruction Funding Eligibility  CDE staff will confirm that the updated plans with budgets are posted at the URL provided before releasing any funds to LEA in 2015-16 15

16 TOM TORLAKSON State Superintendent of Public Instruction Funding Eligibility (Cont.)  CDE must verify that plans contain: –Required activities –Allowable activities –Are reasonable and necessary –No additional administrative costs are interwoven into the activities –All of the current subgrant funds have been allocated –Are of Supplemental nature 16

17 TOM TORLAKSON State Superintendent of Public Instruction Release of Funds  In 2015–16 and each year thereafter, in order to receive the first apportionment in August,  the LEA Plan should be updated with all necessary content and  approved locally by June 30.  The CDE will continue to release Title III funds to LEAs after confirming  there is an updated plan with the budget  The LEA has provided a valid Web link to the Title III updated plan and budget on CARS 17

18 TOM TORLAKSON State Superintendent of Public Instruction 2015−16 Funding Eligibility  LEAs that do not have a plan for the Title III funding are not eligible to receive funds  Funding may be delayed to LEAs who do not provide approvable plan updates and/or links on CARS by June 30, 2015 18
