5 5 Legal background To enable independent railway undertakings to have access to the railway network on a non-discriminatory basis (e.g. telecommunication sector, energy sector) [Directive 2001/14/EC] Non-discriminatory access to service facilities (e.g. transhipment sidings, freight terminals) irrespective of the ownership Independence of essential functions of the infrastructure manager: key infrastructure activities (e.g. capacity allocation- timetabling; charging) are independent of any railway undertaking in legal form, organisation or decision-making functions [Directive 2012/34/EU (Recast)] Act CLXXXIII of 2005 on rail transport Charging statute 83/2007 (X.6.) and its modifications Capacity allocation statute 101/2007 (XII. 22.) The basic principles of capacity allocation and charging are laid down in laws on every level of the relevant legislation hierarchy

6 6 CM Methodological document of network access charges – five-year CD Detailed calculations and data providing the basic of them – yearly Charging Methodology (CM) Charging Document (CD) Cost-based allocated unit prices Direct and indirect costs of infrastructure services Data of actual year costs and state subsidy State subsidy is divided based on transport political principles

7 7 Process of calculation Data request Based on CM Table for data providing Data supply IM: costs and performances Ministry: state subsidy Calculation Charges and mark-ups What market can bear Constructing of CD

8 8 Change in the methodology The base of charge calculation is the total reasonable cost. Total reasonable cost-based charging Direct cost-based charging The base of calculation is the costs directly incurred as a result of operating train service. In case of the charges for the minimum access package and for access to infrastructure connecting service facilities
