4 Dedication, Pride, Service 7-23-094 AB 81 Effective October 1, 2009 Records Bureau Housekeeping –Clarifies eligibility to receive criminal history records –Clarifies difference between name-based & fingerprint-based criminal history records –Removes obsolete language regarding: Missing Persons Collection of statistical data on sex offenders & juvenile sex offenders

5 Dedication, Pride, Service 7-23-095 AB 46 Effective January 1, 2010 Implements NICS Improvement Act in NV –Gives courts the ability to share mental competency records of defendants with the Brady Unit for the purposes of firearms background checks –Allows for an appeals process from being declared mentally incompetent to own a firearm

6 Dedication, Pride, Service 7-23-096 AB 93 Effective May 6, 2009 Changes the definition of Assault –Added the “unlawful attempt to use physical force against another person” –Kept the current definition of “intentionally placing another person in reasonable apprehension of bodily harm” –Can now be used as a potential disqualifier in a Brady background check for firearms purchases

8 Dedication, Pride, Service 7-23-098 SB 28 Effective May 4, 2009 Missing Persons & Unidentified Dead –Requires dental records of Missing Persons / Unidentified Dead to go to County Coroners, not Central Repository or Investigation Division –Local law enforcement no longer required to report Missing Persons/Unidentified Dead to Central Repository or Investigation Division –Deletes record keeping requirements for Central Repository & Investigation Division

10 Dedication, Pride, Service 7-23-0910 Records Bureau Fiscal Year 2010 is budgeted at a 10 % decrease over FY 2008. Fiscal Year 2011 is budgeted at 75% of FY 2009. Elimination of 2 FTE in the Fingerprint Technician Unit. Goals for the biennium include restoring the Reserve balance.

11 Dedication, Pride, Service 7-23-0911 Technology Bureau Elimination of 3 vacant FTEs in the Applications (Programming) Unit due to other DPS Divisions required cuts. Funding allows us to maintain existing systems (with paperclips and rubber bands). Staffing levels allow for only maintenance and small projects. MSA Contractors will be required for new requests.

12 Dedication, Pride, Service 7-23-0912 AB 497 We will be reassigning duties to the fiscal Management Analyst position (currently vacant). Position will be responsible for coordinating the needs of the Judicial Advisory Commission.

13 Dedication, Pride, Service 7-23-0913 Federal Grants Current Grants and Future Applications –2008 SMART Grant (Current) Enhancements to Sex Offender Registry –2009 NCHIP Grant, Awaiting Letter of Award Cooperative effort with AOC for Dispositions –2009 NARIP Grant, Applied 5/22/09 Improvements to Brady Program & Website –On lookout for “any and all” to make improvements
