9 THE PROPERTY OWNERS CONTEND: They are not opposed to the project but rather in favor of this project since 1955. Due to closure of the at-grade intersections, emergency vehicles response time to the subject property would be doubled by the project. Related to the findings of the Commission: That the project is designed with the greatest public good and least private injury. 9

10 THE PROPERTY OWNERS CONTEND: Due to closure of the at-grade intersections, emergency vehicles response time to the subject property would be doubled by the project.  Emergency vehicle response time from the east may be faster after the interchange is constructed since they will not stop to cross Route 101.  Emergency responders from the north may see a slight increase (less than 1 minute) to the current 11 minute response time. This is seen as less than significant by the emergency units. Related to the findings of the Commission: That the project is designed with the greatest public good and least private injury. 10

11 THE PROPERTY OWNERS CONTEND: Emergency evacuation would be difficult for the owners/residents on the west side of the interchange, with closure of the at-grade intersections, in the event of a failure of the interchange (e.g. earthquake) and one access to Route 101. Related to the findings of the Commission: That the project is designed with the greatest public good and least private injury. 11

12 THE PROPERTY OWNERS CONTEND: Emergency evacuation would be difficult for the owners/residents on the west side of the interchange, with closure of the at-grade intersections, in the event of a failure of the interchange (e.g. earthquake) and one access to Route 101.  Controlled access at the new interchange will provide safer ingress and egress to Routes 101 and Route 36.  The Department will provide emergency access at the decommissioned Drake Hill Road intersection for direct access onto Route 101 in the event of a major disaster. Related to the findings of the Commission: That the project is designed with the greatest public good and least private injury. 12

13 THE PROPERTY OWNERS CONTEND: The Department owns sufficient Right of Way and should construct an extension of the proposed frontage road between the interchange and Kenmar Road for public and emergency response access. Related to the findings of the Commission: That the project is designed with the greatest public good and least private injury. 13

14 THE PROPERTY OWNERS CONTEND: The Department owns sufficient Right of Way and should construct an extension of the proposed frontage road between the interchange and Kenmar Road for public and emergency response access.  Over 1.5 miles of additional Right of Way would need to be acquired by the Department to construct the property owners proposed extension of the frontage road.  The construction of the freeway with interchange better serves the access and safety needs of the community. Related to the findings of the Commission: That the project is designed with the greatest public good and least private injury. 14

16 THE PROPERTY OWNERS CONTEND: Increased drainage from the proposed project will dramatically increase run-off/flooding and cause damage to an existing commercial building. Related to the findings of the Commission: That the project is designed with the greatest public good and least private injury. 16

17 THE PROPERTY OWNERS CONTEND: Increased drainage from the proposed project will dramatically increase run-off/flooding and cause damage to an existing commercial building.  The Department has taken measures to prevent any increase in run-off flow from the highway.  The property owner should not experience an increase from drainage run-off to his remaining property as a result of this project. Related to the findings of the Commission: That the project is designed with the greatest public good and least private injury. 17

18 THE PROPERTY OWNERS CONTEND: Dedicated right-turn lanes should be constructed for southbound Route 101 traffic at the Sandy Prairie Road intersection. Related to the findings of the Commission: That the project is designed with the greatest public good and least private injury. 18

19 THE PROPERTY OWNERS CONTEND: Dedicated right-turn lanes should be constructed for southbound Route 101 traffic at the Sandy Prairie Road intersection.  Closing at grade intersections is intended to reduce collisions.  Access cannot be provided at Sandy Prairie Road because it will create an unsafe condition for the traveling public. Related to the findings of the Commission: That the project is designed with the greatest public good and least private injury. 19
