4 Eye Witness Evidence Complicated process of observing and recalling: 1)Sensory Input – info comes in through senses and then encoded for storage in the memory. 2)Storage of what was observed and encoded. 3)The recovery of the information stored.

5 Interrogation The purpose is to elicit information from a suspect or people who are close to the suspect and may have information. A confession will not always be possible.

6 Why some do not confess Have no guilt or remorse. Fearful of the consequences if they betray their accomplice. Have learned that talking digs their own grave. Under Miranda their attorney advises them not to.

7 Miranda 1966 court case, Miranda v Arizona set this as procedural law. 1968 Congress passed law that allowed Federal Prosecutors to get around Miranda. Two things that have to exist to need Miranda: 1) In custody & 2) questioning
