5 WELCOME Welcome to Bay Area Real Estate Information Services, Inc. (BAREIS) We’re glad to have you as part of our organization, and as a new member, this online orientation program was designed to help you understand the policies and protocol of BAREIS MLS. Information is critical to your ability to evaluate, price, and market property. BAREIS MLS is dedicated to providing you with that information, and we’re here to assist you in learning how to utilize BAREIS MLS and related products so that you may reach your full potential in your career as a real estate professional. 7 WELCOME BAREIS is your MLS, a mutual benefit membership corporation established to own and operate a multiple listing service database. The MLS is the vehicle for real estate professionals to: Establish legal relationships with other real estate professionals to make a blanket unilateral contractual offer of compensation and cooperation Provide a central database of available properties for the purpose of appraising and marketing property BAREIS does not fix, control, recommend, regulate or maintain commissions, commission splits or the business models of the members. 8 BAREIS HISTORY Bay Area Real Estate Information Services (BAREIS) was created in 1997 through the combined efforts of five real estate trade organizations in the Bay Area. The founding organizations were the Marin Association of REALTORS®, Napa Association of REALTORS®, Northern Solano Association of REALTORS®, Solano Association of REALTORS®, and the Sonoma County Multiple Listing Service. The organization began full operations in May of 1998. Lesson 1 About the Organization

9 BAREIS HISTORY In October 2000 the Mendocino County MLS joined the effort, followed by the Coastal Co-Op Brokers, representing the southern coast of Mendocino County and the northern coast of Sonoma County, in November 2003 BAREIS now serves approximately 8,000 members in five counties: Marin, Mendocino, Napa, Solano, and Sonoma About the Organization Lesson 1

10 ORGANIZATIONAL STRUCTURE The organization is governed by a board of directors, elected by the membership and made up of BAREIS members. Each year BAREIS holds a general election. Principal Brokers (class A members) can run for a seat on the board. Associate Brokers and Sales agents (class C members) can gain a seat on the board if nominated by the Marin, Napa, Sonoma or Solano County Association of REALTORS® Lesson 1 About the Organization

11 ORGANIZATIONAL STRUCTURE The mission of BAREIS is to “Deliver the most cost efficient and innovative services to our members to enhance the value of their business.” The BAREIS Board of Directors is charged with determining overall policy for the corporation, managing the assets of the corporation, and establishing the Rules and Regulations governing the Multiple Listing Service and Membership. 12 COMMITTEE STRUCTURE When formulating policy or establishing rules, the BAREIS Board of Directors seeks input from the membership through a number of volunteer committees. The committees are made up of volunteers from throughout the region that help provide detailed analysis of problems and proposals, and submit recommendations to the Board of Directors. 26 BAREIS Rules & Regulations were implemented in an effort to keep the MLS data as up to date and accurate as possible. In the event that you feel a rule has been violated, you can report it anonymously to BAREIS. The rules and regulations of the MLS are designed by the membership to govern the procedures for the use of the database, listing property, showing property, making offers, and reporting the sale of property. 28 BAREIS 10 GOLDEN RULES Protect the value of your MLS database. Use, display and downloading of data may only be done per rules. Providing MLS information to anyone other than a client or another BAREIS member diminishes the value of your database. People come to you because YOU have the information. The purpose of the database is to support sales presentations, determine value and sell property. LESSON 2 Rules & Regulations

29 BAREIS 10 GOLDEN RULES Do not provide unauthorized access to the MLS database. There is a great deal of private and confidential information in our database. Your Agent ID, Password, and Authenticated Questions & Answers are NOT to be shared with anyone, not a family member, or someone you may employ, such as an office assistant, or a vendor creating a Website. BAREIS has a special membership rate for non- licensed assistants. LESSON 2 Rules & Regulations

30 BAREIS 10 GOLDEN RULES You must have a valid listing agreement prior to entering a listing into the MLS database. Any listing modification must be authorized by the seller in writing. BAREIS accepts exclusive right to sell, exclusive agency, open and probate listings. Your listings must be in writing to enter a property in the database. Verbal agreements are not adequate. Upon request, you must be able to supply to BAREIS written documentation (i.e. a listing agreement). When a listing date is to be extended past its expiration date, you must have the extension in writing as well. LESSON 2 Rules & Regulations

31 BAREIS 10 GOLDEN RULES Representation about property must be truthful. Any information entered in the MLS must be accurate and truthful. Both the Department of Real Estate and the Statute of Frauds requires all your representations about property listed in the MLS be truthful and accurate. The MLS is a research database. Accuracy is critical to the ability of others to find property, and to appraise, or compile CMAs. LESSON 2 Rules & Regulations

32 BAREIS 10 GOLDEN RULES Listings must be entered in the MLS database within 3 business days. All residential, multi-unit 2-4, lots & land, and mobile/floating home listings are required to be entered within 3 business days of executing the listing agreement. This rule does not apply to multi unit 5+, commercial, and business opportunity or leases. All modifications and changes to the listing must be entered within 3 business days. 33 BAREIS 10 GOLDEN RULES If the seller chooses not to place the listing in BAREIS MLS within 3 business days, or does not want the property to be shown after it has been placed on BAREIS MLS, an Authorization to Exclude must be signed by the seller and submitted to BAREIS. 34 BAREIS 10 GOLDEN RULES When a listing has been excluded from the MLS, it can still be added to the database within 10 days of the closing date for comparable purposes and determining property values. The buyer and the seller must grant permission to the listing agent or selling agent for the comparable sale to be posted to the MLS. The agent must submit to BAREIS the “Permission to Post” form with the buyer and seller’s signatures. LESSON 2 Rules & Regulations

36 BAREIS 10 GOLDEN RULES Your listings must provide accurate information: changes in status or price, reporting correct selling details, and correcting errors and omissions must be done within 3 business days of the change taking effect. Imagine how frustrating it is when an agent takes a client to see a four bedroom home that turns out to be a three bedroom home. Or, when an agent attempts to show a property that has sold or is no longer available. When any change is made to a listing the change must be entered in the database within 3 business days. Your listings must reflect the correct status of the property. When a contract to purchase is accepted on a listing the status must be changed from Active to Contingent or Pending, and when the sale closes it must be changed to Sold within 3 business days. 37 BAREIS 10 GOLDEN RULES When checking off features of the property, if you’re not sure of something, leave it blank. You can always come back to the listing and add it later. For example: if you’re not sure that the seller wants to include the washer and dryer with the sale of the house, don’t guess. Accuracy of each field is critical (e.g. condo cannot go under single family). The listing broker is responsible for truthfulness. Check your listing after it’s entered for accuracy! 38 BAREIS 10 GOLDEN RULES In the event that you have a listing you feel should appear in more than one property category (e.g. commercial with living quarters), area or county, please refer to the Secondary Listings Guidelines available on Rapattoni – Links – Links & documents – BAREIS.com Forms & Lists – Listing Input – Listing Guidelines If you feel that the listing meets at least one of the criteria in the Guidelines, you will then need to follow the instructions for submitting a duplicate listing request to BAREIS. 39 BAREIS 10 GOLDEN RULES Fields in the MLS database may only contain the proper data. All fields in the database are reserved for a specific purpose and specific information. Entering inappropriate data in a field corrupts the database and may result in your listing not showing up if the field is searched. Be especially careful with the Property Description / Public Remarks, because they are transmitted to a number of public Internet sites, IDX Broker sites, and all client reports. Your peers are often uncomfortable sending listings to their clients that contain other agents’ phone numbers and other contact information.

40 BAREIS 10 GOLDEN RULES The Property Description / Public Remarks may not contain any of the following:  Security, alarm codes, or vacancy information  Phone and fax numbers  Company names, including title companies  Agent names  Website or virtual tour links or e-mail addresses  Confidential agent remarks (e.g. property is vacant 9 – noon)  Information regarding purchase price or financing  Any information beyond a physical description of the property and home. 41 BAREIS 10 GOLDEN RULES You may not use an offer to purchase to modify the unilateral commission offer posted on the MLS database. The unilateral offer of compensation posted in the MLS by a listing broker is an unconditional offer of payment to all members of BAREIS that you must pay to another member in the event a member sells your listing. You may not use the presentation of an offer to purchase conditional on changing that offer of compensation. Any modification to that offer between brokers must be made in advance in writing. A listing broker may change a unilateral offer of compensation by posting the change on the MLS. Offers submitted after that date, are subject to the modified commission offer. 42 BAREIS 10 GOLDEN RULES There are restrictions on how you use the listing data of other brokers. You may not advertise on market listings belonging to another agent or broker without consent of your broker and the listing broker. Other than your own listings, you may not pull listing information on other brokers’ listings in the MLS database for mass public advertising in any way, shape, or form (i.e. printed media including flyers, radio, TV, Internet, etc.) unless granted permission by the listing broker. If your broker has agreed to participate in the IDX/Reciprocal/Cooperative Advertising program, you then have the ability to create an IDX (Internet Data Exchange) link through the Rapattoni system and add it to your Website. Members must be compliant in how listings are displayed on their Website, thus the use of an IDX link or using a vendor that has signed a licensing agreement with BAREIS is recommended. LESSON 2

43 BAREIS 10 GOLDEN RULES You can include sold properties in your marketing materials as long as the following disclaimer is included: This information is based on sales reported in Bay Area Real Estate Information Services, Inc. (BAREIS) and is not verified and is subject to change. Listings represented may not have been listed or sold by (agent/firm name). Many brokers have granted permission for their listings to be included in Internet Data Exchange (IDX) broker Websites. BAREIS has very stringent rules regarding the creation of Websites using information from the MLS database. BAREIS does authorize access to vendors for the purpose of creating agent or office Websites. However, the vendor must first be approved by BAREIS, and is required to sign a licensing agreement for access to the database. 44 BAREIS 10 GOLDEN RULES When showing property and submitting an offer, it is extremely important that you follow the Confidential/Showing Instructions posted by the listing broker. Protecting the privacy and security of the sellers is paramount. LESSON 2 Rules & Regulations

45 BAREIS 10 GOLDEN RULES Properties with lockboxes do not give free reign to enter. When the showing instructions state that you cannot enter the property without an appointment, you must make an appointment. When a tenant needs 24 hours notice, you must give 24 hour notice. 50 BAREIS CITATION AND APPEALS POLICY A BAREIS member may request an appeal for a rules violation citation. If a member desires to appeal the citation, the member must complete the online orientation again, pay the fine, and then submit a letter with an explanation of the reason for the appeal within 14 days of the Notice of Citation letter. If a BAREIS member incurs three rules violations within a 12-month period that result in fines, BAREIS may set a hearing to determine if membership should be suspended or terminated. 51 CHANGING OFFICES A member that changes to a new office needs to notify BAREIS of their relocation in writing. It is necessary to inform BAREIS so that the correct office, location and contact information can appear on their listings and Agent/Office roster on the MLS database and the public Websites in which BAREIS participates. An Agent Change form is available on Links – Links & Documents – BAREIS.com Forms & Lists – Membership The form must be signed by the broker or authorized signer for the office. 52 CHANGING OFFICES Under California law, listings belong to the broker. If you are an agent changing brokers, it is ultimately the listing broker’s decision as to whether an agent’s listing(s) may be transferred to the new office. When an agent changes offices, both the former broker and new broker are required to submit an Agent Change Form to BAREIS. To approve the transfer of listings, the listing broker must submit a Listing Transfer Form with both the receiving and releasing broker signatures. These forms can also be found on the membership page of BAREIS.com. LESSON 2 Rules & Regulations

53 CHANGING OFFICES BAREIS staff will not move or modify any listings without the specific written permission of both brokers. When listings are not transferred with the departing agent, the listing broker is responsible for changing the departing agent name on the listing to either his or her own name, or to another agent within his or her office. 55 BILLING PROCEDURE BAREIS service fees are billed quarterly. Payments can be sent to BAREIS or taken to any BAREIS service center. 56 BILLING PROCEDURE Invoices are mailed a month in advance of the due date and fees are due on the due date. The rate that BAREIS is charged by the vendor of the MLS database system is based on the number of members with access. In order to determine what BAREIS is charged, an accurate number of subscribers is needed prior to the beginning of the quarter. Information on the payment terms is available on the reverse side of your invoice. Lesson 3 Billing for Services

57 AGENT/OFFICE ADMINISTRATIVE ASSISTANTS Lesson 3 Everyone that accesses the database must use their own unique log in information, i.e. Agent ID, password, & participation in Adaptive Authentication. For the purpose of keeping the data secure, brokers and agents that employ administrative assistants (administrative users) who access the BARIES database must register those assistants to receive their own log-in (Agent ID), password, and participation in Adaptive Authentication to access the MLS database. When an assistant terminates employment, BAREIS must be notified of this change in order to maintain security of the system. Billing for Services

58 AGENT/OFFICE ADMINISTRATIVE ASSISTANTS Lesson 3 Please bear in mind, permitting others to use your log-in ID and password is providing unauthorized access to the data and carries a $1000 fine for the first offense and possible termination of your MLS services (including lockbox access) for the second offense. Please make sure all of your administrative users and assistants are properly registered if they access the MLS. Membership applications can be found on www.BAREIS.com Billing for Services

59 LATE FEES Lesson 3 Accounts not paid by the due date will have a $25 late fee added. Accounts delinquent for 15 days beyond the due date will have all MLS services suspended (including lockbox access) and an additional $25 reactivation fee will be added. Billing for Services

62 HANDS-ON TRAINING Lesson 4 Hands-on introductory training classes on the MLS are available in all 5 counties within BAREIS service region. A two-month training schedule for each county is available on BAREIS.com along with the Training Reservation process. 63 HANDS-ON TRAINING Lesson 4 BAREIS training classes are free of charge, yet there is a refund- able $40 reservation deposit to be secured by a credit card. This fee will be charged to your credit card if you fail to attend the class. You may cancel a reservation, up to 24 hours before the class. Due to the limited number of seats available, “walk ins” will not be admitted. To secure a seat in a training class, register online through www.BAREIS.comwww.BAREIS.com. MLS Services

64 TECHNICAL SUPPORT Lesson 4 There are several ways to get answers to most of your technical support questions by going to the Help button – Online Help are common questions and answers – Feature Spotlights are short movies on certain topics – Support Center will take you to the Rapattoni Support Center where you can call the number listed or e-mail your question. When calling Rapattoni Support they will ask for your support ID number. BAREIS members all share the same Support ID 3719. The Rapattoni Call Center Hours are: Monday – Friday, 6 am to 5 pm Saturday, 7 am t0 3 pm MLS Services

65 TECHNICAL SUPPORT Lesson 4 BAREIS training staff also provides technical support during office hours when they are not training. Rapattoni handles tech support calls that involve the functionality of the Rapattoni system. BAREIS staff will provide assistance on other issues. 66 TECHNICAL SUPPORT Lesson 4 If you need to make an immediate change to a listing and do not have a computer available, or the system is not allowing you to make the change, submit a Listing Change Form to BAREIS (Rapattoni will not modify listings for you.) 67 COMMUNICATIONS Lesson 4 BAREIS preferred method of communication is through e-mail. Please remember, you are required to provide full contact information including a valid e-mail and fax number to BAREIS MLS and your membership requires you to accept all communications from BAREIS. In an effort to keep members informed and up to date on changes within the organization and the MLS database, BAREIS has several means of communications. A newsletter, BAREIS News, is e-mailed to all members and posted on BAREIS.com bi-monthly. MLS Services

74 LISTING SERVICES Lesson 4 When a real estate agent joins BAREIS MLS, their broker determines whether to give the agent access to the portion of the Rapattoni system that includes loading listings into the MLS database. (Some offices/companies have staff that enters the listings for the agents.) In most cases, the listing agent or his/her assistant are responsible for entering their own listings; this is referred to as a Broker-Loaded listing. Listing Input MLS Services

75 LISTING SERVICES Lesson 4 In the event that you are away from your computer or have a computer malfunction, BAREIS staff is available to enter new listings and make changes to existing listings. The following fees apply: BAREIS Staff-Loaded Listing $25.00 For BAREIS staff to enter your listing, you must submit a completed listing input sheet. The listing will be maintained upon written instructions to staff until either the property sells or the listing expires. The fee will be billed on your quarterly statement. Status Change/Listing Change (broker-loaded listing only) $5.00 When BAREIS staff makes a change to a Broker-Loaded listing, the $5 fee will be billed to your quarterly statement. BAREIS Staff-Loaded Additional Photos The first photo is free, additional photos loaded by BAREIS staff will be billed on your quarterly statement. Listing Input MLS Services

76 LISTING SERVICES Lesson 4 If you have a listing that is not within the BAREIS service region, you can still enter it into the BAREIS MLS database. In some cases the listing can also be entered into the MLS database of the region where the listing actually exists. This is called a Reciprocal Listing. Reciprocal listings are only accepted by out of area MLSs that participate in the Reciprocal Agreement Program. Reciprocal Listings MLS Services

77 LISTING SERVICES Lesson 4 The Reciprocal Agreement Program only allows a listing to be entered into a participating MLS’s database; it does not give access to their database. A nominal fee is charged, and the fee is determined by each individual participating MLS. 78 LISTING SERVICES Lesson 4 BAREIS requires a minimum of 1 photo or graphic image best depicting the exterior of the subject property to be attached to the listing within 3 business days of entering the listing unless the seller signs an Authorization to Exclude form. Photos can be uploaded during listing input or BAREIS can load a photo for you. 79 LISTING SERVICES PUBLIC WEBSITES When a listing is loaded into the BAREIS MLS database, the listing agent, in conjunction with the seller, has the option of having the listing appear on the public Websites in which BAREIS MLS participates. 81 LISTING SERVICES AGENT WEBSITES BAREIS members can create their own Websites or through a vendor. An agent Website can be linked and/or framed to www.GreatHomes.org. If youwww.GreatHomes.org wish to “frame” greathomes.org, simply send an e-mail to frame@norcalmls.comframe@norcalmls.com and request permission to frame the site. There is no charge; use of the site is a benefit of your membership in BAREIS MLS. If a member wishes to include all of the MLS listings on their Website without framing or using a link to www.GreatHomes.org, their broker must have opted in to the IDX Reciprocal/Cooperative Advertising Agreement. This is a program in which brokers may give each other permission to advertise cooperating brokers’ listings in their public Websites. 84 UPDATE Data Share Programs – Single Sign-On Access In early 2007 BAREIS MLS®, MetroList® and the San Francisco Association of REALTORS® launched a data share and open access program between the three MLSs. MLSListings Inc.® participation in this program began in the first quarter of 2009. Access to the East Bay counties of Contra Costa and Alameda became available in mid March 2010. Through Single Sign-On (SSO) technology, real estate professionals that are a member of at least one of the above mentioned MLSs can enter properties for sale or lease and access listing data in the counties serviced by these MLSs. Currently, coverage includes the following counties: Alameda Contra Costa El Dorado Lake Marin Mendocino Merced San Joaquin San Jose San Mateo Santa Cruz Solano Sonoma Stanislaus Yolo Monterey Napa No. San Mateo Placer Sacramento San Benito San Francisco In addition to direct access to the seven MLSs a combined database known as Quattro is available for searching all data in one place. Please note that when you are in a reciprocal MLS you must abide by the Rules and Regulations of that MLS.

Let’s recap what you’ve learned today. BAREIS service region includes Marin, Mendocino, Napa, Solano and Sonoma counties. You are obligated to know the rules and regulations and abide by them. BAREIS members are required to provide a valid fax and e-mail address and accept all communications from BAREIS. Invoices for BAREIS service fees are mailed a month in advance and there is no grace period beyond the due date. BAREIS offers free hands-on training for the MLS system and other related products. When changing offices, members are required to notify BAREIS of their relocation in writing. We realize that the information just provided to you may seem like a lot to comprehend and retain.
