2 Artists’ rights management: from SIREX project to the DRM The role of collecting societies in the digital era Maila Sansaini, General Manager IMAIE (Italy) AXMEDIS CONFERENCE 2005 Florence IMAIE’s role IMAIE is the Institute entrusted by the Italian law with the task to collect and distribute performing artists’ rights deriving from the exploitation or the secondary use of musical and audiovisual works. MUSIC RIGHTS AUDIOVISUAL RIGHTS Secondary use of phonograms, collected since 1975. Communication to the public of audiovisual works collected since 1998. Audio private copying collected since 1992 Video private copying collected since 2003.

According to the above Convention two types of agreements (A and B) were defined between collecting societies of different State members. A-TYPE AGREEMENTB-TYPE AGREEMENT The agreement provides for the exchange of data and remuneration due to Members of each society for the use of their works. The parties do not transfer the remuneration to each other and release one another against individual claims. Through a highly updated technological information system, the Parties guarantee the maximum distribution of equitable remuneration possible to individual performers. The parties provide each other only with general information for the management of rights, the total number of members, protected phonograms, etc. The cooperation between the two collecting societies strengthens performers’ rights internationally. The two societies collect on each other’s behalf the remuneration due to the performing artists of the two countries and distribute them to the rightholders of their own country. The GROUP’s goals were: provide standard and common elements for the exchange of information from each society; create a common platform so as to access to the local database relative to the distribution of rights for performing artists; allow each society to identify its own members and repertoires so as to make claims, collect and distribute the remuneration accrued in other countries. 7 INSTITUTE FOR THE PROTECTION OF PERFORMING ARTISTS’ RIGHTS INSTITUTE FOR THE PROTECTION OF PERFORMING ARTISTS’ RIGHTS Artists’ rights management: from SIREX project to the DRM The role of collecting societies in the digital era Maila Sansaini, General Manager IMAIE (Italy) AXMEDIS CONFERENCE 2005 Florence SIREX EVOLUTION Cooperation and testing brought the interested societies, with the addition of RAAP (Ireland) and GDA (Portugal), to make the following changes in the SIREX: System centralization: all societies can upload their data in the system hosted by one collecting society (i.e. AIE), facilitating the system’s maintenance with less expenses. Lay out of the system activities: the uploading and processing of data take place in an asynchronous way, i.e., it is not required that the operator remains connected until the operations are completed; the operations result is communicated via e-mail. Management of the problems solving: an information system has been set up to trace malfunctionings and problems resolution (ISSUE TRACKER) and is accessible by all users. Management of the project documentation: a system has been set up for the on line management of the whole documentation on the SIREX project and the Madrid Group’s activities (SHAREPOINT).

This proposal is extremely current and related to the issues discussed in this Conference. The GRIX system is intended to extend the operation field through the creation of two tools shared by a group of collecting societies: Global Recordings Index a general index of the recordings, possibly based on the ISRC coding system, created through the matching of the societies playlists Global Recordings Index a general index of the recordings, possibly based on the ISRC coding system, created through the matching of the societies playlists Global Playlist System a system of unified playlists, thus making it possible for societies to make claims for the repertoire that they manage on a unique system. Does not allow interaction among the different systems and technologies. Identification of the use of the specific contents, i.e. the specific protected work. Does not guarantee equal remuneration of copyright and related rights. Allows payment of any possible rights, or parts of them, relative to the use of contents. Does not guarantee the equal distribution of remuneration to all rightholders. There isn’t just one DRM standard model. Can easily be cracked by pirates.

The rightholders of the above rights are: authors, publishers, producers and performing artists. The industry of technology and storing media can, thanks to this new opportunity of the market and new demand, sets specific supply through new business models to increase the right earnings of the sector.
