2 Chapter 23 Out-of-State Pharmacy Purpose – To regulate pharmacies that provide services to LA Citizens – Generate income Impact on pharmacy practice – ‘Regulates’ out of state pharmacies too protect the public – Sometimes gets pharmacists a cool trip*

3 Why Regulate and who to regulate? (2301 – 2303) Why – Because the PPA requires it Who – Pharmacies providing services (drugs or pharmacy information) – Those who provide services through the internet. – Must have a license in other state – Must have someone and some place in LA – Pharmacists must be licensed in the state they practice

4 Requirements of OOS pharmacies (2305 – 2307) Requirements – Apply and pay fees – Have a PIC licensed in LA Pharmacist-in-Charge – Must be licensed in LA and in home state – Other PIC rules apply from Chap 11

5 Regulation of the OOS pharmacy (2309 – 2313) The portion of the pharmacy that supplies LA is inspectable by the LA BOP And that portion must follow ALL LA laws Records kept for two years (at least)

6 Counseling and Closing (2315 – 2319) To provide the required counseling – Toll-free number Must have adequate lines Must be on every bottle – Must provide consistent, adequate care Closing – 10 days notice – Must notify board of where LA patients can transfer from Jurisdiction – All OOS that solicit, receive, dispensing and delivering drugs or devices
