2 General Health Act Article 217.
For purposes of this Act, alcoholic beverages are considered those which contain minimum alcoholic strength of 2 % vol. up to 55% vol. If the alcoholic strength is superior from the above mentioned specification, it is not allowed the commercialization. Article 218. All the alcoholic beverages must display the following warning statement in their containers: "abuse of this product is harmful to your health", written in easily legible print, in contrasting colours and without invoking or referring to any statutory provision. The Ministry of Health shall publish in the Official Gazette of the Federation the agreement by which other precautionary legends may be established, as well as the provisions for their application and use. Article 220. There is no way that alcoholic beverages may be expended or supplied to minors. Violation of this provision will be comparable to the offense of corruption of persons under eighteen years old or the offense of persons who do not have the capacity to understand the facts and meaning or persons who do not have the capacity to resist it.

3 Special Tax for Products and Services Act.
Article 2. – The value of the acts or activities that are indicated below, will apply the following rates and dues: I. In alienation or, in case of, importation of the following goods: A) Alcoholic beverages and beer: 1. With an alcoholic calibration up to 14 ° G.L % (wines) 2. With an alcoholic calibration of more than 14 ° and up to 20 ° G.L % 3. With an alcoholic calibration of more than 20 ° G.L %

5 NOM-142-SSA1/SCFI-2014 Objective:
NOM Publication: OGF, March 23, 2015. Objective: This Standard seeks to establish the sanitary specifications and sanitary and commercial labelling provisions of alcoholic beverages distributed and sold in Mexican national territory. Scope: This Official Mexican Standard is mandatory in all national territory for individuals or entities in the business of processing or importing alcoholic beverages. Export products are exempt.

8 NOM-142-SSA1/SCFI-2014 Labelling (general provisions) Pre-bottled alcoholic beverages must be displayed with a label that describes the product or that uses words, illustrations, or other graphic representations referring to the product that act as a graphic description of suggested preparation and use, unless there is already a legend alluding to that matter. The labels displayed must be attached in a way that they are available up to the moment of use and consumption under normal conditions and must be applied to each unit, multiple or collective packaging; with clear, visible, permanent, characters in contrasting colours that may easily be read by the consumer.

NOM-142-SSA1/SCFI-2014 Labelling (general provisions) The information contained on the labels must be presented in a clear, accurate, and verifiable manner that avoids false, inaccurate, or misleading information regarding the nature and characteristics of the product. At least the name or generic product name, alcohol content, and trademark must appear on the main display area, as well as the quantity information.

10 Presentation of the Information
NOM-142-SSA1/SCFI-2014 Presentation of the Information Pre-bottled alcoholic beverages must show the mandatory information in the Spanish language, regardless of whether it is also present in other languages. The information must be highly visible in clear, contrasting, legible characters under normal purchasing and use conditions, except for the information required under other legal provisions, such as specific size and bottling characteristics.

12 Additional Commercial Information.
NOM-142-SSA1/SCFI-2014 Additional Commercial Information. This may consist of the beverage's history, recipes, sayings, phrases, symbols, abbreviations, numbers, advertising slogans, refrains, etc., as well as written, printed, or graphic information, provided they do not mislead or deceive the consumer. They may appear in a language other than Spanish without having to be translated.

14 1. Purpose  Scope: all alcoholic beverages (including wines). The denominations of national and international appellations of origin are recognized, as well as their respective regulations/standard when is applicable.  Regulation of the alcoholic beverages market in Mexico in order to provide certainty about their authenticity to the consumers, with the aim of avoiding commercial and deceptive practices.

16 3. Final Remarks 1 Draft NOM was notified to the WTO contact point. On February 23, 2017 was approved by the Consultative Committee of the Ministry of Economy and its publication is pending in the Official Gazette of the Federation because last week we receives comments from the Attorney of our Ministry. 2 The benefit of having a regulation that establishes wine and spirits denomination provides competitive advantages in the market and fair rules for all players, as well as consumer confidence. 3 It will be exigible for import and export for wine and spirits. The conformity assessment procedure will be published for public consultation. MX is aware of the need to facilitate trade: “one standard, one test, accepeted everywhere”.

Next steps 1 The future NOM-199-SCFI-2017 on Alcoholic Beverages considers a category of Mexican wine. 2 MX is committed to review and study the OIV Recommendations with the aim to harmonize -gradually- its standards with international standards (whenever is possible and applicable). 3 Once MX gathers technical information on which main differences are between our regulatory framework and OIV standards, we will program and coordinate activities with other government agencies for achieving the goal.
