Tinker v. Des Moines School District
Upheld the symbolic speech of students and argued that, in order to justify censorship, school administrators had to “be able to show that actions were caused by something more than a mere desire to avoid discomfort or unpleasantness that always accompany an unpopular viewpoint.”
Bethel School District v. Fraser
The Supreme Court ruled that free speech, as defined by Tinker, did not justify Fraser’s speech because of the obscene and vulgar language used.
Why did the Supreme Court act differently in the two cases?
