To assist in the redevelopment of properties that are dormant or underutilized due to liability associated with real or perceived contamination Purpose of the Brownfields Program

6 Program Eligibility Property must meet the definition of a “Brownfield” per the Small Business Liability Relief and Brownfields Revitalization Act (Brownfields Law)

7 Program Eligibility- Property
Properties that are NOT Eligible: Federal property NPL / Superfund sites LUST sites Permitted sites Sites under orders

8 Program Eligibility- Applicant
Applicant must: Be a governmental entity or nonprofit Not be a Potentially Responsible Party as defined by CERCLA

Apply to the Brownfields Program Conduct Phase I Perform Geophysical Investigation Conduct Phase II Provide Additional Assitance

10 Application Process Apply to the Brownfields Program
Submit Application Submit Access Agreement signed by property owner Receive Application Acceptance Letter

Phase I Environmental Site Assessment Phase II Environmental Site Assessment Site Activities Conducted by State Contractor: Geophysical Investigation Tank Pulls Engineering Estimate for Cleanup Remediation Plan

TCEQ Voluntary Cleanup Program Assistance with application Provide fee waivers Federal Grants Grant Writing Workshops Grant Support Letters
