3. Important to Note:

1) Learnerships not registered by the DG of DHET are not valid, which therefore makes a SETA non-compliant. Leaners cannot be registered nor funded.
2) Reg. 7a-Time Lines: Learning starting way back vs funding. DHET Response-Impact on report-Recommend to stick within 30 days (From the date the learner signed)-SETAs to find a way to ensure stakeholders comply with Regs. E.g. Training started in Dec, LA signed and registered in Apr Time lines are implemented for a purpose as employers complained that SETAs are not registering learners in time. Each is SETA is requested to have its own policy on the management and implementation of these regs, where possible, aligned to DG Regulations.
3) All documents prior Apr LA submitted prior April vs Training Implementation. DHET Response-All LAs submitted prior 1 April 2019 will be considered in line with LR 2007.

4) Implication of Conditional Enrolment being terminated-Impact clarification: DHET Response-This must be based on whether the submission is compliant or not. If a SETA receives an LA that is not compliant, they will not process it until the gaps identified are closed. If the stakeholder is not accredited for the intervention the SETA will not enroll that learner.
5) Electronic signed Agreements- Are they acceptable?: DHET Response-They will be accepted.
6) RECORDS required Reg 21(2) i.t.o. hard vs soft copies clarification?: DHET Response-This will be verified through DHET principals and guidance will be provided. This is not condoning the electronic processes, but the regulation, as the standing principle, currently requires hard copies for auditing purposes.
7) DHET COMMENT: Information required as per Annexure cannot be amended unless you are officially notified by the DHET. However, if your SETA requires additional documents to the form, they may do so.
