First Degree Murder - Committed with Malice (having intent to kill) and premeditation
Felony Murder – Any killing that takes place during the commission of certain felonies (i.e. rape, burglary)
Most states consider this first degree murder even without Premeditation or malice

Second degree murder - Committed with malice but without premeditation
Voluntary manslaughter – Occurs after the victim has committed an act that would cause a reasonable person to lose self control(Heat of passion). Cannot be provoked by words alone. Must occur before a “cool down” period.
