2. Alcohol as a drug Affects your overall driving ability

Affects your driving even if your below the level of legal intoxication
Number 1 reason for fatal accidents

3. Blood Alcohol Concentration
BAC is the measurement of the amount of alcohol in your system
Test of blood, breath or urine
Illegal to drive if your bac is.08 or greater (21 years old or older)
12 oz. of beer, 5 oz of wine and 1½ oz. of hard liquor all contain the same amount of alcohol
Time is the only way to remove the effects of alcohol, food, coffee and showers do not speed up the elimination of alcohol
Usually, heavier people have more blood and body fluids to dilute the alcohol.

5. Driving Under The Influence (DUI)
Serious offence
if arrested, you will be taken to the police station or county jail
You will be held until your bond is posted
Legal fees can run thousands of dollars
If convicted- remain permanently on your driving record.

6. Implied Consent Law
you automatically give your consent to submit to certain tests following arrest for DUI

7. Statutory Summary Suspension Law
If arrested and find to have a BAC if .08 % and/or a trace of a controlled substance, your driving privileges will be suspended for at least 6 months
If you refuse to submit to testing, your license will be suspended for at least 1 year

8. Statutory Summary Suspension Law
second offense within a 5 year period, license will be suspended for at least 1 year if you fail the test and 3 years if you refuse to test
If you refuse, Officer will take your license at the time of your arrest and provide you with a temporary receipt allowing you to drive for 45 days
If you refuse to submit to testing, it will be used against you in court

9. DUI Conviction –
First DUI conviction will result in the loss of your driving license for a minimum of one year (21 or older)
Maybe fined up to $2,500 and given a jail sentence of up to 1 year
If you are convicted of a second DUI in 20 years, you will lose your license for a minimum of five years, sentenced up to 48 hours in jail or 10 days of community service, fines up to $1,200.

10. DUI Conviction –
BAC .16 or more while transporting children under 16 greater penalties, including higher fines and community service or jail time.

11. DUI Conviction – (your day in court)
If you are convicted of a DUI, you must meet the following requirements to get your license back
High risk auto insurance – 3 years
Reinstatement fee
Lose license for a minimum of 1 year
Undergo an alcohol and drug evaluation
Successfully complete a rehabilitation program

12. Illegal Transportation of an Alcoholic Beverage/open containers
No drinking by any person in vehicle
Traffic citation to driver and passengers
No containers that are opened may be in the passenger area
May be fined up to $500
Second offense within 1 year, license will be suspended or revoke for 1 year

13. Parental Responsibility
Illegal for parent /legal guardian to allow persons under 21 to consume alcoholic beverages or fail to control access to alcohol on private property

14. Contributing to DUI
Illegal to allow someone to drive your vehicle if you know that person is under the influence
If you provide alcohol to person under 21 fined $2,500, jail sentence up to one year and driving privileges suspended

15. Zero Tolerance Suspension
Under 21 years old
Any trace of alcohol – suspended for 3 months, if you refuse to submit to testing – suspended for 6 months
Second offender, suspended 12 months if you fail, 36 months if you refuse to test
License revoked 2 years if convicted of DUI

16. Detecting Drunk Drivers
Law enforcement officials say there are several signs associated with drunk driving:
Making wide turns
Weaving, swerving, drifting, or straddling the center line
Almost striking an object or vehicle
Driving on the wrong side of the road
Driving at a very slow speed
Stopping without cause
Braking erratically
Responding slowly to traffic signals
Turning abruptly or illegally
Driving after dark with headlights off
