2 Why change? Industry initiatives such as the Performance Assurance proposals being developed under the Performance Assurance Workgroup will require industry data to be made available to selected third parties (for example an academic partner to assess the Gas Market Settlement Risk). Currently as drafted the UNC does not permit the release of this data to those parties. Development of future modifications may require independent analysis of data and without an approved modification the UNC there permission to release the data nor is there a mechanism for costs to be agreed and paid/recovered.

3 Options New governance arrangements are needed to authorise the release of protected/confidential data to designated third parties. The group need to consider how any costs incurred by Xoserve in supplying data to approved third parties would be recovered for mods that haven’t yet been approved or which ultimately may be rejected.

4 Solution Extend the provisions of Section V 5.1 to allow Authorised Third Parties to receive Protected Information. Agree governance arrangements for the designation of an organisation as an Authorised Third Party, and Produce a guideline document detailing under what circumstances data may be released and the necessary safeguards that need to be put in place for management of that data and it’s treatment at the conclusion of the permitted activity.

5 Recommended Steps The Proposer recommends that this modification should be: Not be subject to self-governance because it may have a material impact on the uniform network code governance procedures or the network code modification procedures; Sent for workgroup assessment to develop the modification for 3 months.
