2. Undocumented Student Legislation New York State
The state of New York has provided in-state tuition to eligible undocumented students since 2002.
9612-A Eligibility Requirements
Attend at least two years of high school in New York
Graduated from a New York high school or received a GED
Apply for attendance at an institution within 5 years of receiving a diploma
Show proof of residence
File affidavit declaring that you will file for legal status when able

3. Undocumented Students In-State Tuition Rates
E. CITIZENSHIP/IMMIGRATION STATUS:
1. Are you a citizen of the United States? q Yes q No If you answered “yes,” proceed to Section F (Residency). If you answered “no,” what is your country of citizenship? _________________________________________ (Proceed to question 2)
2. If not a U.S. Citizen, do you currently have an immigration status? q Yes q No If yes, are you a:
Legal permanent resident (Attach a copy of both sides of your permanent resident card)
Visa holder: List visa type: ________________________ (Attach a copy of your current visa and Form 1-94). Visit cbp.gov/194 to download the form.
If you do not hold lawful immigration status, have you attended a NYS high school for 2 years and graduated or earned a NYS GED within the past 5 years? • Yes q No If yes, submit the Student Affidavit of Intent to Legalize Immigration Status which will be mailed to you.

4. Undocumented Students In-State Tuition Rates
Undocumented students who have attended a New York State high school for 2 years and graduated or earned a New York State GED within the past 5 years are mailed the affidavit. The student may choose to complete the affidavit to receive in-state tuition rates or choose not to complete the affidavit and receive out-of-state tuition rates.
The affidavit is not filed separately within Internet Native Banner and so there is no way to generate a list of students who filed the affidavit.
I do not currently have lawful immigration status, but have filed an application to legalize my immigration status, or will file such an application as soon as I am eligible to do so.
The affidavits are in an undisclosed secure location with extremely limited access.
The affidavits are required by New York State Legislation in order to provide eligible undocumented students with in-state tuition rates.

5. Deferred Action for Childhood Arrivals DACA
All DACA students are undocumented but not all undocumented students are DACA recipients.
June 15, Deferred Action for Childhood Arrivals was implemented as an executive action. The program was for a very specific population of undocumented students who met established criteria.
Allows for work authorization
Offers two years of stay from deportation
Renewable every two years for $496
800,000 people participated in this program

6. Deferred Action for Childhood Arrivals DACA
DACA applications were sent directly to the Department of Homeland Security from June 5, until October 5, 2017.
No college has access to information regarding who is or is not a DACA recipient on their campus.
The student can choose to self-disclose.
Does not have an impact on tuition.
Does not have an impact on ability to be admitted to the institution.
May have an impact on ability to complete programs of study that end with licensure.

7. Security, Safety and Support for our Undocumented Students
Suffolk County Community College does not have a list of undocumented students.
Based on SUNY recommendations Suffolk County Community College did not declare itself a sanctuary campus.
Suffolk County Community College stands with SUNY on its Affirmation of Support for Undocumented Students.
Includes that we will defend the privacy rights of students.
President McKay signed the following petitions calling for the continuation of DACA.

8. The Undocumented Student Task Force
Began informally with people interested in supporting undocumented students.
Recognized by College administration in Spring 2017 as questions regarding security and safety of our students surfaced.
Primarily have supported undocumented students, faculty and staff through educational programming.

9. The Undocumented Student Task Force
Current Goals and Projects
Provide support for our undocumented students
Ensure accurate information is available for our students through a variety of mediums. This includes a webpage, resource tables, access to legal services and points of contacts.
Mobilization team
Develop a team that will react and organize quickly if legislation that will negatively impact our undocumented students is considered.
Develop an distribution list of people interested in participating.
Develop sample syllabus statements for faculty to elect to adapt to provide support for our students.
Educational programming
Continue to provide educational opportunities for students, faculty and staff to learn more about immigration and undocumented people.
Provide Rapid Response Training with JWJ
Visual campaign
Provide a visual campaign across all three campuses to demonstrate support for our undocumented students.
Develop a safe space campaign.
