“Legal” operations often on disadvantageous terms:
Capacity to negotiate
Lack of transparency (no level playing field)
Misconception about roles (for example EU as donor and commercial party)
Regulatory and enforcement jurisdiction (legislation, capacity, know-how)
Lack of equipment to inspect and enforce
Substantial costs involved in enforcement
Unclear legal position: e.g. shark fins
Difficulties in enforcing sanctions (costs, lack of cooperation, human rights, UNCLOS)
