18 TITLE IX & STUDENT JUSTICE

19 TITLE IX Compliance BCTC cares. We want our students to have a great educational, social and personal experience while attending our college. BCTC strives to recognize human dignity and therefore does not tolerate sexual harassment or any other type of harassment within or connected to this institution.

20 Title IX Title IX of the Education Amendments of prohibits sexual discrimination in any form; to include any form of sexual harassment and gender discrimination. Federal law states: “No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any educational program or activity receiving Federal financial assistance.”

21 What is sexual harassment?
Sexual Harassment is any threatening, demeaning, or offensive conduct or situation that unreasonably interferes with a student’s work setting or creates a hostile academic environment. “Sexual harassment in education includes any unwanted and unwelcome sexual behavior that significantly interferes with a student’s access to educational opportunities. The Supreme Court has confirmed that schools have an obligation under Title IX to prevent and address harassment against students, regardless of whether the harassment is perpetrated by peers, teachers, or other school officials” (Title IX, 1972).

22 What Is Sexual Assault? Sexual Assault refers to sexual activity where consent is not obtained or freely given. Victims include men, women, and members of the lesbian, gay, bisexual, and transgender (LGBT) community. Statistics show that perpetrators are usually men and often someone whom the victim knows. The aggressor can be, but is not limited to, a friend, a coworker, a neighbor, fellow student, or family member.

23 Retaliation BCTC strictly prohibits retaliation against any person for filing a complaint about harassment, for making a request that harassing conduct stop, or for assisting a person with a harassment complaint.

24 Why should you tell someone?
You may not be the only person who is being harassed by this individual. Report sexual harassment to: Campus Security The Asst. V.P. for Students Rights and Responsibilities / Dean of Students School Counselor Faculty A family member A close friend, so it will stop.
