Why is the crown asked to be prevented from excluding potential jurors who are black? Why has the case got so much publicity? If the defences motion succeeds what would it mean?

3 Why is the crown asked to be prevented from excluding potential jurors who are black?
In order to level out the playing field, they want people who are capable of sympathizing with the problems faced by blacks.

4 Why has the case got so much publicity?
According to Toronto’s black community they believe that the case has received the publicity because Vivi Leimonis was white and the accused robbers are black

5 If the defences motion succeeds what would it mean?
It would mean the crown couldn’t dismiss a black potential juror without a reason acceptable to the defence.

He was accused of murder in a gangland style killing of two Vancouver drug dealers Ms. Guess was a member of the jury deciding on Mr. Gill’s guilt or innocence She believed he was innocent, and helped him win acquittal of the murder charges

Ms. Guess is accused of obstructing justice by having the affair while Mr. Gill was on trial Crown alleges that she was biased in his favour and influenced other jurors to free him

She acknowledges that she fell in love with Mr. Gill, but denies committing any crime

Mr. Bellows (prosecutor) told the court that “overt interaction” beginning with “considerable eye contact and subtle gestures” between Ms. Guess on the jury and Mr. Gill in the prisoner’s box, in the July- October trial in 1995 She was later seen outside the courtroom during break meeting with Mr. Gill. 6 jurors testify that from the first straw vote taken in the jury room Ms. Guess maintained that Mr. Gill was innocent. She tried to influence their deliberations, warning them inaccurately that they would have to reveal their position in public if the trial resulted in a deadlock
