The fast improvements in technology have resulted in features of our personal lives becoming vulnerable to attack. Mobile phones are a prime example of how governments, corporations and even other individuals can violate a person’s privacy. The Newcastle Herald (21/07) found that mobile phone applications have recently come under scrutiny by International and Australian legal and non-legal systems due to their inability to protect people. A prime example is seen in the recent amendment to the Crimes Act 1900 (NSW) where a person’s privacy now includes “any data stored on any device”. Paragraph 1 As a result, law reform is now more effective, however can be considered unresponsive. This is due to the fact although protection of people’s privacy under the law has improved, it takes a considerably long time to change or reform legislation. In this case, mobile applications have existed since the early 1990’s, yet NSW legislative reform had not taken place till July, 2015.
