1 E.O. 13508 Chesapeake Bay Protection and Restoration
Proposed Coordination Roles & Approach to Section 203

2 Agenda 1. Straw Conceptual Framework for Section 203 Coordinated Implementation Strategy 2. Generalized Timeline for Executive Order 3. Proposed Process for Developing Implementation Strategy 4. Proposed Roles and Responsibilities for Implementing the Executive Order

3 Straw Conceptual Framework for Executive Order 13508, Coordinated Implementation Strategy

4 Principles and Parameters of the Document
Be a coordinated, comprehensive strategy including federal, state and local activities Highlight a new commitment by federal government, but be respectful and consistent with work done by CBP Focus on coordinating strategies, but not represent federal, state and local consensus Include a prioritized set of actions, not simply a laundry list of possibilities Be clear, understandable and relatively brief. Be set to a timeframe (3 to 5 years?) including milestones.

5 Principles and Parameters of the Document (cont.)
A preliminary draft would be prepared for FLC and PSC review at 120 days. The draft Coordinated Implementation Strategy would be released on November 9, 2009 along with the federal section 202 reports. Following public comment, the document would be revised to fully integrate section 202 report recommendations and include revisions to CBP goals, milestones and strategies. Desired end result would be a final Coordinated Implementation Strategy released jointly by the FLC and CBP in May 2010.

6 Elements of the Coordinated Implementation Strategy Document

7 I. Background and Context of the Chesapeake Challenge
Provide a concise description of the environmental problem – the scope and scale of environmental and natural resource degradation in the Bay

8 II. Chesapeake Bay Restoration Goals
In addition to providing an overall vision of a restored Bay, this section would be organized around restoration goals. The starting point is proposed as the five existing CBP goals Each of these goals would have explicit indicators The goals and indicators will likely evolve over the 365 day process

9 III. Highest Priority Strategies and Actions (organized by goal)
Presents a limited set of strategies and actions with the greatest effectiveness and efficiencies Describes the rationale used to analyze options Includes summaries of actions specific to each agency. Discusses other programs and approaches under development. Indicates milestones for action progress and completion

10 IV. Data Collection and Distribution Mechanisms
Describes mechanisms such as the AIP from CAP for coordinating information to support progress reporting, adaptive management and accountability V. Adaptive Management and Periodic Evaluation Process Explains the need for excellent, well organized data on which to base decision making. Describes in more detail the adaptive management framework and how it will be employed to ensure effectiveness and a focus on priorities

11 VI. Timeline with Milestones
Describes timeline and process for moving forward: In preliminary (120 days) and draft (180 days) strategy, outlines process/timeline leading to final implementation strategy In final strategy (365 days), outlines timeline feeding into annual Chesapeake Bay Action Plan and Annual Progress Report (Section 205)

23 Administrator Jackson Letter to EC Members
Begins a new era of shared federal leadership, in close collaboration with EC and other state partners Looking forward to a continued close partnership as we implement the EO’s directives EO calls for an unparalleled collaboration between federal and state agencies and departments Section 204, “Collaboration with State Partners” directs the FLC to consult extensively with Bay States and DC Administrator knows that fed/state collaboration is vital to success. Administrator pledges that she and staff will work closely with EC to implement EO

24 EO Consultation Memo to PSC Members
June 11, 2009 Memo from William Early and Preston Bryant As part of the “extensive consultation with states” required by EO, EPA will employ several methods to ensure this occurs PSC is a key forum for consultation while developing EPA’s draft & final reports, and the overall integrated strategy Builds upon the pledge that EPA Admin. Lisa Jackson made in letters she sent to EC members Goal of consultations is to share preliminary ideas early, and to get feedback from PSC Will occur through a series of meeting and forums with PSC members PSC hopes to have similar consultations with other lead Federal agencies in the development of their reports and strategy

25 PSC Consultation Opportunities
Initial Ideas- Next 30 Days Designed to gather ideas early in the process from PSC members Briefing of R3 State Water Directors at a meeting earlier this month EPA will schedule state-by-state meetings with PSC members Proposal sharing- before 120 days (Sept. 12, 2009) Meet with PSC members at next schedules PSC meeting in July Opportunity for PSC feedback prior to submission to FLC
