3. Statement of Officer Form
As a general rule, no city or county officials file with SOS – they file on the local level. The Legislature amended the Texas Constitution, Article 16, Section 1, in November 2001:
SOS no longer requires non-state-level elected officials to file Statements with SOS. (County Clerk, City Secretary, or Board /Commission secretary.

Oath must be administered by someone authorized to administer an oath under Texas law.

9. Certificate of Election
After completion of the canvass, presiding officer of local canvassing authority shall prepare a certificate of elections for each candidate who is elected.

Candidate’s Name;

Statement that the Candidate has been Elected to an Unexpired Term, if applicable;

12. Certificate of Qualification
The County Clerk certifies the names and dates of qualification for county elected officials to the Secretary of State for issuance of Certificates. The County Clerk submits to the Secretary of State a certified statement containing the name of each candidate elected to a county office, the office to which he or she was elected, and the date the elected candidate qualified for office.
A memo is sent in December to the County Clerk. The clerk will go online and enter the information regarding the county elected officials.
The County Clerk will enter the elected officials information. After entry of the information, print it, place the seal on it and mail it to our office. Then SOS will send the Certificate of Election.
