9 Risk Management Supplier Qualification: BNSF Logistics offers an in-house dedicated Supplier Services team to ensure that transportation suppliers are properly vetted and approved before use. Insurance: In addition to providing our clients with the protection of using a provider with industry leading business and package policies, BNSF Logistics offers a competitive and comprehensive Shipper’s Interest cargo policy to provide protection to the client for high-value and high risk shipments. HSE (Health, Safety, Environmental) Policy: The HSE policy establishes the basic responsibilities for designing, executing and monitoring the safety, health and environmental program applicable to BNSF Logistics and its subsidiaries/contractors. Anti-Corruption / FCPA (Foreign Corrupt Practices Act) Certification Process: Engaging an overseas Global Service Provider (GSP) to provide services to be paid by BNSF Logistics must gain approval from the BNSF Logistics Compliance team prior to using each GSP. Export Compliance: BNSF Logistics International has focused efforts on continued development of an Export Compliance Program to ensure compliance with US Export law and regulations. Summary

20 Anti-Corruption Certification Process
All employees engaging a new intermediary (e.g., freight forwarder or customs broker) to provide services to BNSFL must prepare a Business Justification Statement and submit it to the Compliance Team at For intermediaries with foreign government touch points (e.g., customs) and annual spend < US$10,000: The intermediary must complete a simplified Due Diligence Questionnaire and sign an Anti-Corruption Compliance Certificate. The Compliance Team performs background checks on these intermediaries. For intermediaries with foreign government touch points and annual spend > US$10,000: The intermediary must complete a more comprehensive Due Diligence Questionnaire and sign an Engagement Agreement and Anti-Corruption Compliance Certificate. The Compliance Team performs a more comprehensive series of background checks. A country corruption perception index of <35 + US$10,000 spend requires additional diligence. Other red flags during the due diligence process could trigger additional diligence. Intermediaries with no foreign government touch points may qualify for reduced diligence. An intermediary is ineligible for use or payment until required diligence has been completed and the intermediary has been approved by the Compliance Team.
