3 Excessive Bail & Fines 8th Amendment
Bail set must have some relationship to: Gravity of the offense Likelihood of “jump bail” Denial of bail does not constitute excessive bail

4 Speedy & Public Trial 6th Amendment Speedy trial Public Trial
Protects against unreasonable delays Public Trial Prevents government from conducting trials in secret

5 Grand Jury Indictment 5th Amendment
Charges person with a crime by issuing an indictment Required in federal cases, not in states

6 Trial by Jury 7th Amendment Guaranteed in criminal cases

7 Witness 6th Amendment Suspect has the right to bring witnesses and cross-examine witnesses

8 Cruel & Unusual Punishment
8th Amendment Punishment must be proportionate to the crime Death penalty is not cruel and unusual CA Three Strikes Law – 25 years to life

9 Double Jeopardy 5th Amendment
Person may not be tried for the same crime twice
