Bail set must have some relationship to: Gravity of the offense Likelihood of “jump bail” Denial of bail does not constitute excessive bail

Speedy & Public Trial 6th Amendment Speedy trial Public Trial
Protects against unreasonable delays Public Trial Prevents government from conducting trials in secret

Grand Jury Indictment 5th Amendment
Charges person with a crime by issuing an indictment Required in federal cases, not in states

Trial by Jury 7th Amendment Guaranteed in criminal cases

Witness 6th Amendment Suspect has the right to bring witnesses and cross-examine witnesses

Cruel & Unusual Punishment
8th Amendment Punishment must be proportionate to the crime Death penalty is not cruel and unusual CA Three Strikes Law – 25 years to life
9
Double Jeopardy 5th Amendment
Person may not be tried for the same crime twice
