3 Review – evaluation that technical documentation has been prepared in accordance with H&S legislation and standards Designer is obligated to, during the preparation of technical documentation regarding the legislation related to construction, elaborate measures in accordance with technological terms of reference for execution of works of facilities, planned for use as work and utility facilities and facilities used for work on open space Employer is obligated to provide review (evaluation) from qualified company that technical documentation has been prepared in accordance with h&s legislation and standards, that employees' safety is provided in facilities used for work process, and that requirements defined by technical terms of reference are fulfilled All of the abovementioned is related to facility exploitation

4 Safety plan – site logistic plan
Must be prepared in accordance with rulebook of content of site logistic plan –safety plan It is mandatory for demolition, reconstruction and construction of facilities Elaborate consists of two parts: Elaborate for preparation, setup and usage of construction site with access roads – general elaborate (site logistic plan) Elaborate of safety measures on work positions, movement of employees with high risk of injures and professional diseases and employees'’ health damage – special elaborate (safety plan) Elaborate must be signed by lead or responsible engineer on site, and verified by employer’s or supervision representative All of employees on site, who participate of work activities must be informed with elaborate content before start of execution of works On site must be record that all of employees are informed about methodology of execution of works and h&s measures

5 Notification of start of construction Works to H&S inspection
Notification of works commencement must be sent by employer who plans that works will last more than 30 working days and that more than 20 employees will work at the same time or if it is planned to work more than 500 employees, or works last longer than 500 days Notification of works commencement must be submitted to inspection authorities at least five days before commencement of execution of works Safety plan – site logistic plan must be submitted to inspection authorities together with Notification of works commencement

6 Certificates of previous and periodic testing of working equipment
It must be prepared in accordance with rulebook of procedures and deadlines for periodic testing and certification of working tools, plants and equipment and ppe and working environment Examples on construction site: Lifting equipment - cranes Heavy equipment Metalworking Machinery Wood processing machines Compressors and diesel generators Electrical and lightning conductor installations for all connections and temporary facilities on site (must be executed in accordance with temporary electrical installations design) Cables, cords and chains Scaffolding in accordance with design signed by responsible engineer, together with statement that scaffolding have been installed in accordance with design

7 Company H&S rulebook, employment contract annex
Company h&s rulebook must be prepared by employer, in accordance with H&s law and company statute Company h&s rulebook defines : Organisation and implementation of h&S Rules of H&S Rights and obligations of all employees Methodology of H&S management Methodology of checking of health status of employees Training and testing methodology of employees’ competence for safe work Ppe usage Integral part of company h&s rulebook is ppe normative

8 Risk assessment document
Risk assessment document must be prepared in accordance with H&s law Risk assessment document must be prepared for all work positions Risk assessment document defines work positions with high risk, health requirements for all employees, usage of working tools, plants and equipment Risk assessment must be performed in accordance with rulebook of methodology and procedures of risk assessment Risk assessment document determines: Risk Identification Works positions that are exposed to identified risks Possibility of work injuries, professional diseases Risk acceptance Implementation of measures for reducing of unacceptable risks Risk assessment document update must be performed in cases: Of appearance of new risks and changed risk levels When defined measures are not appropriate Adaptation, reconstruction, accidents, general repair Serious, collective and fatal work injury When risk assessment document Is based on inappropriate data Employer is obligated to inform all of the employees with risk assessment document

9 Report of previous and periodic health checks
Employer is obligated to provide health checks to employees who have been appointed on work positions with special working conditions, i.e. high risk positions Employer is obligated to provide health checks at least once in three years, on employee’s request In case that employee does not fulfil special heath requirements for work positions with special working conditions, i.e. high risk positions, employer is obligated to assign the employee on position that correspond to employee’s health capability Health checks performs legal entity with adequate stuff, technical and technological competence in accordance with special rulebook Authorized institution must submit to employer report of performed previous and periodic health check of employee

10 H&S certificates and H&S training program
Employer is obligated to perform training of employees for safe work, in accordance with h&s program H&s training must be performed during the working hours and training expense must be paid by Employer Employer is obligated to, during the h&s training, inform employees about all risks on position that employee will be appointed on and safety measures H&s training must be performed theoretically and practically Testing of theoretical and practical competence of employees, employer must perform on position of work

11 Contract defined by article 22 from H&S law (work of multiple employers)
When two or more employers execute works on same construction site, each of them is obligated to organise activities on site in a way that activities by employees of one employer do not jeopardize health and safety of employees of other employer All employees, who execute works on same construction site, are obligated to, before commencement of works, sign the contract of mutual right and obligations Contract must be submitted to inspection authorities at lest five days before commencement of woks Implementation of abovementioned obligation has been very problematic in reality, especially on large construction sites with large number of contractors and subcontractors

12 Appointment of employees certified for first aid, fire fighting and evacuation of employees
Employer is obligated to take all necessary actions and appoint employees for first aid, fire fighting and evacuation of employees Number of above mentioned employees, qualifications and available equipment depends on level of risk on construction site, but must not be less than 1 Most important thing is education of employees on construction site (information of role of appointed employees, procedures in case of injury or fire, evacuation plans, protection signs etc.)

14 Collective insurance for work injuries, professional diseases and diseases related to work
Employer is obligated to insure all of employees from work injuries, professional diseases and diseases related to work Insurance expenses must be paid by employer, and are defined according to risk level regarding to work injuries, professional diseases and diseases related to work

15 Appointment of H&S Manager, department or contract with accredited company for H&S Management
Employer organises h&s activities in accordance with law on following ways: Appoint H&s manager Organise h&S department Engage accredited company for h&s management It is necessary for all employers on site to have written appointment of responsible h&s manager or contract with accredited company for H&S Management

16 H&S annual report Employer is obligated to prepare annual report (at least one) regarding h&s Employer is obligated to, on inspection’s demand, provide h&s annual report, provided measures as well

17 H&S Records Employer is obligated to prepare H&S record, where all of previously mentioned documentation is directly or indirectly contained Content and form of records are defined by special rulebooks Records must prepared for: Work positions with special work conditions and high risk positions Employees appointed on work positions, especially on Work positions with special work conditions and high risk positions Work injuries, professional diseases and diseases related to work H&s trained Employees Hazardous substances used during the work process Performed tests of working environment Performed periodic testing and certification of working tools, plants and equipment and ppe reports Previous and periodic health checks Technical documentation H&s documentation

18 Procedure of entrance and exit from site and behaviour on construction site
Procedure of entrance and exit from site can be defined, beside law requirements, by contract between employer and contractor Procedure can be defined by contract from article 22 from H&S law This way, person in charge of coordination and supervision of application of H&S measures on construction site, can be appointed There are examples in practice in Montenegro (H&s manger of employer, H&s manger of main contractor and H&s manger of supervision team) One of the possible ways of procedure of entrance and exit from site is authorization Authorization means that person in charge of coordination and supervision of application of H&S measures on construction site authorises entrance of certain company on site regarding general h&S documentation Authorization applies to entrance of workers, tools, equipment, machinery and vehicles on site Beside documentation required by h&s law, additional required documentation can be defined by contract

Beside authorization, person in charge of coordination and supervision of application of H&S measures on construction site can be responsible for informing of workers with general h&S measures on site (site induction), before entrance on site, i.e.: Informing about documentation on site, procedures, typical risks Informing about procedures in case of injuries, fire, about evacuation plans and responsible personnel on site Informing about location of welfare facilities on site, places of safe entrance and exit from site Informing about protection signs on construction signs Keeping the site clean Informing about smoking prohibition, alcohol and drugs on site, as well as usage of Ppe on site All of present during the presentation have to sign statement that they have been informed about general h&s measures on site and they receive helmet sticker (identification of inducted workers) and record must be prepared for above mentioned

24 Coordination between H&S Manager and security service on construction site
Security service on construction site must be informed about procedures for entrance and exit form site List of authorized workers, tools, equipment, machinery and vehicles must be submitted to security service Entrance to site could be controlled by handwriting, id cards, helmet stickers and, if it is available, cards for access control barriers In case of visitor entrance to site, it is necessary to have good communication between h&s manager and security service (short training, accompanied by h&s manager, spare ppe for visitors on site)
