2 Contract Agreement The FIDIC Conditions of Contract do not impose a Contract Agreement, a “Letter of Acceptance” is considered enough The PRAG however, as well as legislations in most of the EU Member/ Candidate Countries, require a Contract Agreement signed by all parties In the case of the EU financed projects, the Contract Agreement will be signed by the Contracting Authority, Beneficiary (if different), endorsed by the EC Delegation and finally, signed by the Contractor The Contract shall become valid only after the signature of the last party (generally the Contractor)

3 Content of Contract Agreement (Annex D4)
Parties: Contracting Authority (Beneficiary) and Contractor - note that EC Delegation is not a party in the Contract, it only endorses the contract as a proof of the financing commitment. Contract may be endorsed by other parties that co-finance it The subject of the Contract (works to be executed) The documents forming part of the Contract, in the same order as in FIDIC Clause 1.5 – note connection with Particular Conditions of Contract The “Accepted Price of Contract” Signatures of the Parties

5 Standard Forms Information contained in the Standard Forms will be used for the evaluation of the Tenderers capacities and will become binding as parts of the Contract For this reason, the Tender Dossier will clearly specify the exact information required When drafting the Evaluation Grids it will be considered the actual required information This should be an iterative exercise for ensuring the right information is requested, respectively sound evaluation criteria are provided, matching the requested information

6 PRAG - Standardised Formats
For ensuring a consistent approach, PRAG provides a full set of forms, for all the documents used in the project implementation, from Global Contract Forecast up to Contract Assessment Form These standardised forms are to be used in all EU financed projects, in all countries It allows a universal “language”, structure, approach, implementation and monitoring of the EU funds management
