Victor Zhukov Clarivate Analytics, IP Expert, Middle East, Africa and Russia/CIS Telling good patents from great

2 Which patent values more?

3 What would you say?

4 And now?

5 IP ANALYSIS TECHNIQUES TRADITIONALLY
Typical patent analysis largely driven by measurement of patent (or patent family) volumes, or changes in volumes

6 NOT ALL PATENTS ARE CREATED EQUAL
Same applicant, same year, different results Which is more valuable, which is more important? Individually, provides information on strategy of applicant, notable pieces of IP requiring more intense review Aggregating the information, the totality of outcomes becomes quite powerful.

7 AGGREGATED QUANTITATIVE METRICS
Proxy for Citation Frequency Technical Impact Filing Breadth Monetary Investment/Strategic IP ID Grant Success/Commitment Market Selection, Technical Commitment Technical Breadth Market Applicability, Infringement Opportunity Opposition Survival Validated IP Litigation Notification Applicant/Owner Assertiveness Youth Remaining Life of Patent Value

8 Wouldn’t it be great if …

9 …clear patent value metric existed?

10 But that is not possible 

11 Benchmarking matters a lot in science

12 Why not use that for patents?

13 Patent portfolio strength changes over time

14 QUALITATIVE MEASUREMENTS
Less statistical and more subjective, but can include elements such as: There is evidence that quantitative and qualitative measures strongly correlate Infringement Detectability Measure for the ease of detecting infringement of technology covered in the target patent by competitor products. Inventions with higher infringement detectability are generally more “enforceable” in nature, and therefore potentially more valuable. Claim Scope Reviewing claim language, the claim scope is marked as broad, medium or narrow. Generally, the broader the claim scope the better the coverage, and hence the protection for a given technology. Design-around Protection Based on claim scope, technological coverage of the invention, and also on the likelihood of finding products related to the invention. The stronger the design-around protection, the better. Likelihood of Use Considering that relative age of the technology domain, most of the inventions will have a use or may be useful if some improvements are brought about. Invention for which there is a likely use are rated more than ones which may be useful. There are others that, however, are
