2 Objectives of the Technical Pillar of the 4RP
“Safety First” Facilitate the completion of the Single European Railway Area - removing the remaining technical barriers The European Union Agency for Railways has been established in 2004 (as “European Railway Agency”), with the main task of proposing the technical and legal framework for the Single European Railway Area (SERA). The main objectives of the Agency have been to improve Safety and Interoperability on the European railway network. Thus, the Agency deals with all technical issues arising when a train crosses an inner border in the EU, e.g. by creating creating common rules for safety and operation, by establishing Technical Specifications for Interoperability (TSIs), or by acting as the system authority for the European Rail Traffic Management System (ERTMS).

3 The Interoperability Vision
The legacy of national monopolies with national rules means that where rail could be most competitive (long distance freight and medium distance high speed passenger), fragmentation undermines competitive position of railways (“95% of our traffic is national”) One set of rules (= network)

4 Key Elements of the Technical Pillar
The Agency will issue single EU-wide vehicle authorisations and safety certificates to train manufacturers and railway undertakings The Agency will be in a position to issue an approval required for the NSA authorisation of ERTMS trackside projects (a binding opinion on ERTMS trackside specifications) All applications to the above processes will be handled by the so-called One-Stop-Shop developed by the Agency Covering applications at the Agency, but all national applications for Safety Certification, Vehicle authorisation, and trackside/infrastructure authorisation as well Cooperation with NSAs (pool of experts) ERTMS System Authority What are the main changes? The Success of the Technical Pillar Needs Full Commitment of All Actors Adopt Implementing Acts during transition period for: - practical arrangements for vehicle authorization and safety certificates - principles specifying fees and charges payable to the Agency (12 legal acts in total, to be adopted during transition period) Commission Put in place national legislation to transpose the 4th railway package by 15 June 2019 Member States Conclude cooperation agreements before end of transition period Agency and NSAs

Description of the tasks Conditions for deliverables and applicable time limits Applicants’ fees distribution between Agency and NSAs Without prejudice to the Agency’s full responsibility for its decisions Cooperation agreements (to be signed with all NSAs) Vehicle authorisation and safety certification for national traffic (if applicant decides so) Authorisation of railway infrastructure Supervision (NSA) Accident investigation (NIB) Tasks remaining under Member State responsibility
