2 BACKGROUND Effective April 1, 2013
“Posting of Public Notices Regarding Slavery and Human Trafficking” Requires certain CA businesses to publicly display a notice containing human trafficking info Posting must have the National human trafficking telephone hotline numbers English, Spanish and Vietnamese

3 SB 1193 The public notice must state:
“If you or someone you know is being forced to engage in any activity and cannot leave -- whether it is commercial sex, housework, farm work, construction, factory, retail, or restaurant work, or any other activity -- call the National Human Trafficking Resource Center at or the California Coalition to Abolish Slavery and Trafficking (CAST) at KEY-2- FRE(EDOM) or to access help and services. Victims of slavery and human trafficking are protected under United States and California law.” Simplified Chinese and Tagalog

4 SB 1193 English, Spanish & language most spoken in the business’ location No identification of entity/agency to distribute postings Prosecution for non- compliance $500/$1000 civil penalties No designation for particular use of civil penalties collected English, Spanish and Vietnamese

5 MANDATED BUSINESSES On-sale general public premises licensees under the Alcoholic Beverage Control Act Adult or sexually oriented businesses Primary airports Intercity passenger rail or light rail stations Bus stations Truck stops Roadside rest areas Emergency rooms within general acute care hospitals Urgent care centers Farm labor contractors Privately operated job recruitment centers Businesses or establishments that offer massage or bodywork services for compensation that are sole proprietors who employ unlicensed massage therapists

6 SIGIFICANCE “…the most important provisions to increase human trafficking arrests are requiring the National Human Trafficking Hotline number to be posted in public places.” 2016 Report: “Identifying Effective Counter-Trafficking Programs and Practices in the U.S.: Legislative, Legal, and Public Opinion Strategies that Work” Primary purpose to provide Businesses; Employees; The public; and Victims National telephone hotline numbers to seek help and report unlawful activities

7 CHALLENGES IDENTIFYING MANDATED BUSINESSES
No public listing for adult or sexually oriented businesses Sole massage proprietor or employees not licensed; unregulated entities and workers not on any radar

Since 2015 San Francisco Department of Public Health Issuing citations for public hearings to massage parlors for non-compliance with SB 1193
