CERN’s response will be sent to all bidders, including the request for clarification but without identifying its source Bidders shall acknowledge receipt of the Cover letter with bid shall acknowledge each individual CERN clarification correspondence received

7 Selection and Adjudication Criteria
Adjudication basis: The contract shall be awarded on a « lowest compliant » basis to the bidder whose bid complies with the technical, financial and delivery requirements and is the lowest* * Subject to the rules aiming at achieving well balanced industrial return coefficient for Member States (MS) PB= Poorly Balanced WB= Well Balanced

8 Selection and Adjudication Criteria
Concept: improve the distribution of our purchases among CERN MS The country of origin is the country where the firm in charge of the related activity is established with the provision that activities subcontracted will be taken into account. Industrial return coefficient: The ratio between that Member State's percentage share of all purchases of supplies (excluding purchases funded by non-Member States) during the preceding four calendar years and that State's percentage contribution to the budget over the same period. Well balanced Member states: BU - CH - CZ - FR - HU - IT The tender shall be treated as that from a PB MS provided that the value of supplies originating in one or more PB MS is not less than 60 % of the total amount of the contract.

9 Realignment Rule Scenario 1: Lowest bid from a PB MS contract placed
Lowest bid from a WB MS (a) 1st bidder (within 20%) from PB MS aligns contract placed (b) if not, 2nd lowest bidder (within 20%) from PB MS aligns contract placed (c) if no alignment, contract placed with lowest bidder from WB MS

10 Price Basis All prices (incl. options) shall be quoted in CHF or EUR or the preferred currency of the bidder (if you wish to be paid in this currency), free of taxes, not subject to revision. Price table format of Tender Form to be complied with. Validity of the bid: 6 months from the closing date.

11 Payment Conditions (tender form § 5)
Payment subject to provision of a bank guarantee for the performance of his obligations under the contract. The bank guarantee, in favour of CERN, shall be issued by a bank approved by CERN, for an amount corresponding to 20% (twenty per cent) of the total amount of the contract and valid until expiry of the warranty of the supply. The bank guarantee shall be established using the template provided as Annex 1 of the General Conditions of CERN Contracts. 20% (twenty per cent) of the total amount of the contract becomes due thirty days after signature of the contract, CERN’s receipt and acceptance of a correct invoice for the same amount and receipt of the bank guarantee stipulated here above. 50% (fifty per cent) of the total amount of the contract becomes due thirty days after completion of the installation of the supply on the CERN site and CERN’s receipt and acceptance of a correct invoice. 30% (thirty per cent) of the total amount of the contract shall be paid by CERN thirty days following acceptance of the supply and CERN’s receipt of a correct invoice for the same amount.
