XIX century - title system in Transylvania, Banat, Bucovina (deed system - French civil code for all other regions) main law enacted (Law-Decree nr. 115/1938) 1948 – nationalization of the real estates 1991 – restitution begun (not finished yet) new land registry law (Law nr. 7/1996) organisational change (birth of the ROMANIAN AGENCY FOR CADASTRE AND LAND REGISTRATION - ANCPI) E-terra IT system (v3 rolled out) new Civil Code systematic registration starts(ongoing process)

CHALLENGES two coexistent land registry systems
two different organisational cultures parallel evolution of cadastre and land registry 50 years gap due to restricted legal traffic of real estates restitution of the nationalised/expropriated real estates legislation instability (more than 33 changes of the law, so far) political influence corruption

SETTING UP A NEW FRAMEWORK new common regulations, new common workflows confusing vision on cadastre and land registry functions overlapping COMPUTERIZATION transparent and trackable workflows faster processes standardised outputs technology dependence

RIGHTS & WRONGS DEFINING THE COMPLEMENTARY ROLE OF CADASTRE AND LAND REGISTRY different objects: immovable for cadastre (boundaries, description, identification, etc.) rights for land registry (but object of the right is the immovable) same outcome: CERTAINTY ones uncertainty shall not affect others certainty FOCUS ON INTERCONNECTION & INTEROPERABILITY fast organisational evolution constraints (legislation, partners development status) FALSE TARGETS higher precision of measurements overregulation

Cadastre & land registry are having different tasks, but complementary roles Cadastre & land registry are running at different speeds Define the objects Define specific goals Define liability Define interference area and it’s rules Avoid overlapped checkings, but not the necessary double checkings
