Existing Healthcare Stock – Is it compliant? i.e. does it meet the Design Intent of the Existing Fire Cert & TGD B Scope definition is essential for Existing Building Upgrades Are your Passive/ Active/ Fixed Fire Systems maintained? Passive Active Fixed Some sophisticated Healthcare Owners are assuming Ancillary Certifier inspection roles for critical building systems Example of a redundant ductwork system which had 8 Smoke and Fire Dampers installed on it tied into a newly refurbished area in a Healthcare Facility. Of 8 FSD, 3 were failed closed, 4 operated correctly and one was not installed at all. None of the dampers had access hatches.

The “Building Designer” under BCAR Certifies the Design and coordinates to the Design of other design team members Signs Certificate of Design Compliance on Commencement Design Team Ancillary Certifiers: Civil/ Structural Mechanical & Electrical Fire & Disabled Access Acoustics/ Landscape Architects Sub- Contractors Specialists (Fire Alarm/ Emergency Lighting /Lifts/ Façade, Roofing etc) Concerns due to increased exposure to potential Design Liability

8 Assigned Certifier Drafts Preliminary Inspection Plan at Commencement stage Input from Design Team and Builder Alignment with Builders Program Inspects & Coordinates the Inspections of others Collects Ancillary Certs at Commencement & Completion Signs Certificate of Compliance on Completion Inspection Plan as Implemented on Completion

9 Ancillary Certification
The “Designer” and Assigned Certifiers sign their respective Certificates “having relied on ancillary certificates” where they do not have the pre-requisite competence Prof’ Indemnity Insurance: Designer & Assigned Certifiers PI cover for Specialist Designers required by Ancillary Design Certifiers as per SD /SC /Si Certs

10 Ancillary Certification
PROFESSIONALS & SPECIALISTS Different types of Ancillary Certs Implications for Specialists Commissioning Specialists who don’t install. Which Cert? Manufacturer Certs/ DoP’s CIRI Board Registration SUB-CONTRACTORS This certificate relates to the buildings or works as described above to include all associated design necessary for the completion of the Sub-Contractor’s element of the works as detailed in the attached Annex. I confirm that I am the Sub-Contractor/Specialist Contractor assigned by the Builder/Main Contractor to construct, supervise and certify the building or works outlined at 3 above. I certify, having exercised reasonable skill, care and diligence, that the building or works outlined at 3 above as completed have been constructed in accordance with the plans, specifications, calculations, ancillary certificates and particulars as issued to me relevant to the above building or works at 3 above, and such other documents relevant to compliance with the requirements of the Second Schedule to the Building Regulations as shall be retained by me as outlined in the Code of Practice for Inspecting and Certifying Buildings and Works. Reliant on the foregoing, I certify that the works are in compliance with the requirements of the Second Schedule to the Building Regulations insofar as they apply to the building or works concerned.

11 Ancillary Certification
Ancillary Certificates are signed on a company basis by a Principle or Director Ancillary certifiers & Inspectors must exercise reasonable skill, care and diligence in the exercise of their duties Ancillary Inspectors and Certifiers are often not the same person Consultants/ Specialists or Architect/ Engineer with relevant design experience should certify the design compliance at Pre-Commencement stage Assigned/ Design/ Builders Certs signed by Individuals PI from an Ancillary Certification perspective are not well defined but they should be considered carefully by the Design & Assigned Certifiers Inspectors with relevant practical on site inspection experience should inspect the on site elements of works

17 Summary Owners need to be fully aware of their legal responsibilities and actively endorse a culture of BCAR compliance Professionals and Specialists need to step-up to the plate Ancillary Certifiers & Building Owners have a key role to play in delivering BCAR Design/ Assigned/ Ancillary Certifiers need to have consideration for competence, impartiality and objectivity if the system to work
