December 2020: Temporary Modification RMH
December 2021: Temporary Modification RMH
December 31, 2022: BHCCSD/BH proposed temperature Temporary Modification expires

4. SOBP
Data showed ambient temperature exceedances of CS-I standards above and below BHCCSD WWTF.
BHCCSD has a demonstrated year-round permit compliance problem.
Significant uncertainty exists as a result of natural or irreversible human-induced causes.
Plan to resolve uncertainty:
BHCCSD/BH will collect additional temperature data
BHCCSD/BH will conduct side-by-side temperature measurements in 2015 to verify data already collected
CPW, Black Hawk and BHCCSD will coordinate to collect additional fish population data
It is anticipated that UCCWA and others will collect additional water quality data
BHCCSD/BH will work with other entities for macroinvertebrate sampling

5. Proposal
Segment 13b: Mainstem of North Clear Creek including all tributaries from Chase Gulch to Clear Creek.
Extend the current temporary modification for temperature (T=current condition) until December 31, 2022.
Will allow time to collect data following construction of the mine WTP
Will follow Regulation 38 Basin RMH schedule
Will follow the submittal of the next 5-year review report for Superfund Project around 2020
