2 Sources of Law: Review Primary Sources
- Primary Sources are “the law.” Statutes Case Law Agency Regulations Constitutions Secondary Sources Secondary Sources are any materials that analyze, explain or otherwise comment on primary sources.

3 Secondary Sources: Why?
- Published/updated frequently. - Breaking news – E.D.N.Y. Decides Etc.! - Find new/interesting topics to write about with the latest developments. - Primary sources do not always explain the law. - Judicial Opinion on Employment Law: “Affirmed.” - Expert analysis/conclusions save you time. - Help to focus your research - Find a topic and learn about it quickly. - Find search terms/link to other resources.

4 Westlaw Westlaw has a dedicated “Practice Area” page for Employment Law. 1 2 This is one stop shopping for all employment law resources on Westlaw. To access, click the “Practice Areas” tab on the main page and select “Employment Law.”

5 Westlaw Newsletters - Short articles updating people on changes/trends in the law. - Usually frequently updated (check database info). - Focus on a specific topic or subtopic. Employment Alert “Employment Alert is a newsletter containing practical advice on how to reduce liability risks when dealing with employees, explanations of benefits, and human resources trends.” Police Department Disciplinary Bulletin “Disciplinary missteps can cost plenty for your department. Even with well-written personnel policies, you are bound to face claims of disparate treatment, discrimination, sexual harassment, or civil rights violations. Within your force you may have to address insubordination, off-duty misconduct procedural violations, drug testing, and constitutional rights issues.” Drugs in the Workplace “[D]iscusses the detection and resolution of substance abuse problems in the workplace and academic institutions, including drug-testing protocols and procedures, trends in the treatment of drug and alcohol abuse, drug-usage patterns, and employer-sponsored programs that address substance abuse.” Termination of Employment Bulletin is “[A] monthly newsletter providing a full array of protective strategies to block employee lawsuits before they start.”

ABA Journal of Labor & Employment Law Westlaw Law Reviews/Journals Scholarly publications where students, judges, and other experts write about new or controversial areas of law. Westlaw can limit your search to publications dealing with only labor and employment law. They work hard so you don’t have to! 7 Lexis Lexis also has a dedicated “Practice Area” page for Labor & Employment. 1 To access, click the “Practice Area or Industry” tab on the main page and select “Labor & Employment Law.” 2

8 Lexis News/Legal News Click the link under News or Legal News on the Employment Law Page to search for articles flagged as relevant to labor and employment law. You can use the templates to limit your search. Lexis lets you search many “fields” – that is, you can search just article headlines rather than the full text of the article! If you do not want to use the templates, you can run a keyword search using the main red search box. You can limit your search results after you see what results were located.

9 Treatises, Practice Guides & Jurisprudence
Lexis Treatises, Practice Guides & Jurisprudence A treatise is a book or series of books written about a specific area of law. You can look for topic ideas in the ToC or, if you have a topic in mind, you can find more information before making your final topic selection. Click the name of the treatise to open a search template. Click the table of contents icon to view the ToC.

10 Bloomberg BNA Guess what?!? Bloomberg also has a dedicated “Practice Center” page for Labor & Employment Law! 1 To access, click the “Practice Centers” tab on the main page and select “ Labor & Employment Law.” 2

BNA Law Reports provides expert analysis of pending and recently decided cases. 2 There is also analysis of current events – for example, this article evaluates Judge Thomas Hardiman’s record on employment cases. 1

Bloomberg BNA Labor and Employment Blogs In the age of the Internet, the ability to blog has expanded opportunities for commentary. 1 Blogs are forums where people can quickly address developments in the law. Make sure the author/blog is reputable before citing/believing! 2
