23 Manitowoc County Shoreland Ordinance
Effective October 1, 2016 Purpose (Wis. Stat. § ) Preserve the safety and well being of the people who utilize the shoreland. Aid in the prevention and control of water pollution. Protect spawning beds, fish and aquatic life. Control building sites, placement of structures and land uses. Preserve shore cover & natural scenic beauty.

27 Building Setbacks Required setback is 75’ or an average setback if the proposed development qualifies. All structures are required to meet the setback from the OHWM unless they are identified and qualify as an exempt structure.

28 Impervious Surface Standards
What is an impervious surface (IS)? An area that releases all or a majority of the precipitation that falls on it. Roofs, driveways, patios, sidewalks, etc. Remember that the shoreland zone is 300 ft. from any rive or stream and 1000 ft. from any lake. Of course, if a property owner wishes to exceed the 30% cap, applying for a variance is an option. This proposal seeks to halt any further expansions of impervious surfaces while allowing a landowner to have a well maintained usable property in exchange for addressing water quality through approved methods (mitigation). This increases property values and water quality for a positive impact. Habitat and scenic beauty are challenged by the location of the activity however all reasonable efforts will be made to enhance this right a well.

What is the standard? For riparian lots, or non-riparian lots that are entirely within 300 feet of the OHWM. Up to 15% impervious. Between 15% - 30% with mitigation. Impervious surfaces within 300 feet of OHWM divided by lot area. Remember that the shoreland zone is 300 ft. from any rive or stream and 1000 ft. from any lake. Of course, if a property owner wishes to exceed the 30% cap, applying for a variance is an option. This proposal seeks to halt any further expansions of impervious surfaces while allowing a landowner to have a well maintained usable property in exchange for addressing water quality through approved methods (mitigation). Measurement is normally to roof ridge. Chimneys, etc. have not been typically counted in the measurement. Model ordinance diagrams.

34 Non-Conforming Structures
A lawfully placed structure that does not comply with the required setback from the ordinary high water mark as identified in NR (1)(b).

35 Nonconforming Structures - activities now allowed
A nonconforming structure may be maintained, repaired, replaced, restored, rebuild or remodeled if the activity does not expand the footprint. Includes principal and accessory structures.

36 Nonconforming structures – activities allowed cont.
A nonconforming structure may be expanded vertically within setbacks. Max. 35’ height. Principal and accessory structures. 2nd story to a residence or garage. Changing roof pitch and side wall height on shed.
