4 FMR § May we sell personal property at fixed prices to State agencies? Yes, before offering to the public, you *may offer the property at fixed prices (through the State Agencies for Surplus Property) to any States, territories, possessions, political subdivisions thereof, or tax-supported agencies therein, which have expressed an interest in obtaining the property. For additional information, see subpart G of this part. *federal agencies are NOT required to offer the property at fixed price to the SASP

5 FMR 102.38.340 (a) Competitive sale to the public;
§    How may we sell personal property to State and local governments? You may sell Government personal property to State and local governments through (a) Competitive sale to the public; (b) Negotiated sale, through the appropriate State Agency for Surplus Property (SASP); or (c) Negotiated sale at fixed price (fixed price sale), through the appropriate SASP. (This method of sale can be used prior to a competitive sale to the public, if desired.)

6 FMR §    Do we have to withdraw personal property advertised for public sale if a State Agency for Surplus Property wants to buy it? No, you are not required to withdraw the item from public sale if the property has been advertised.

7 FMR §    Are there special provisions for State and local governments regarding negotiated sales? Yes, you must waive the requirement for bid deposits and payment prior to removal of the property. However, payment must be made within 30 calendar days after purchase. If payment is not made within 30 days, you may charge simple interest at the rate established by the Secretary of the Treasury as provided in section 12 of the Contract Disputes Act of 1978 (41 U.S.C. 611), from the date of written demand for payment.

8 Interest and Penalty Rate Percent and penalty for non-pay by 30 days time frame Current rate is 1% Treasury may adjust yearly After 60 days of non-payment a penalty of 6% per year and admin charges of $10/month flat fee is applied Penalty and admin charges are coded to Treasury funds and not GSA funds. Only principle is associated to GSA

9 Compliance Federal donation program funds can NOT be used to pay for the fixed price vehicles Cost and “seed” money to purchase vehicles can NOT come from the Donation program Fixed price sale is a sale – not a Donation Exception: if a SASP acquires a vehicle to run the Donation program

10 Compliance (cont) Federal property that requires reimbursement is not eligible for the Donation program ( (g)) Fixed price sales can NOT be made to a non-profit regulations state that the sales are made to a State, territory, or possession of the United States, or to a political subdivision of, or a tax-supported agency in, a State, territory, or possession SASP may be an inactive participant in sales to eligible participants (e.g., bring parties together) Speculative fixed price sales are inappropriate. SASP should have a targeted eligible purchaser

Acquisition Upon notification to the personal property sales office, the requested property is removed from the available listing The Sales Contracting Officer coordinates with the owning agency for concurrence of Fair Market Value (FMV) sale Completion of contract award documents Purchase receipt forwarded to the SASP and owning agency Payment and Collection delayed payment up to 30 days; (FMR ) Removal SASP coordinates with owning agency to schedule appointment for removal; within 10 days of award
