4 HSA Review Unit 4 – Rights & Responsibilities
Today we will look at Criminal Law

5 Criminal Law The investigation and prosecution of crimes. Everyone is presumed innocent until proven guilty. The gov’t must prove you DID it, instead of you proving you did not do it.

6 Elements of Criminal Law
Grand Jury Group of people who analyze the evidence gathered against an individual and decide whether or not there is enough evidence to charge someone Indictment Formal charges brought against an individual from the grand jury

7 Elements of Criminal Law
Prosecutor Lawyer representing the gov’t who is trying to put the accused in jail for as long as possible Defense Lawyer representing the accused who is trying to keep them out of jail

8 Elements of Criminal Law
Public defender Lawyer issued by the gov’t for those who can not afford one on their own Subpoena A formal request for someone to testify in court. Individuals have information that may be helpful for either side

9 Elements of Criminal Law
Habeas corpus The idea that the gov’t must tell someone why they are being arrested as well as the charges that are brought against them. President can suspend habeas corpus only during wartime

Petit jury Group of 12 people who listen to the evidence provided and decide the verdict Verdict Decision of whether the person is acquitted (innocent) or convicted (guilty)

Plea bargain Negotiation between the prosecution and defense to agree to plead guilty in exchange for less years. Advantages: Much cheaper, less years Disadvantages: Less years, no chance to prove innocence

Read the paper presented and answer the questions on your note sheet. This is a GROUP activity, so you must work together! Do not talk to people at other tables!!
