Management of industrial chemicals and hazardous wastes in all aspects of its life cycle, “cradle to grave”- importation, distribution, use, manufacture of chemical substances and generation, transportation, treatment, storage and disposal of Hazardous Waste.

5 DENR and Policy on RA 6969 It is the DENR policy to regulate, restrict or prohibit the importation, manufacture, processing, sale, distribution, use and disposal of chemical substances and mixtures that present unreasonable risk and/or injury to health, safety, security and the environment.

DEPARTMENT ADMINISTRATIVE ORDER REVUSED PRIORITY CHEMICAL LIST PRIORITY CHEMICAL LIST - List of existing chemicals that DENR has determined to potentially pose unreasonable risk to public health, workplace and the environment. There are 48 chemicals listed on the PCL (including compounds). PCL

11 DAO Authorizes the DENR to prescribe additional requirements and establish procedural requirements for issuance of a PCL Compliance Certificate. SQI

12 Who are covered by the PCL process?
Importer-distributor - a single proprietorship, partnership or corporation that engages in importation and distribution of PCL chemicals. Importer-User-Manufacturer - a single proprietorship, partnership or corporation that engages in the importation and production using PCL chemicals as raw materials for transformation into new products and other usages. User-Manufacturer - a single proprietorship, partnership or corporation that engages in production using PCL chemicals as raw materials for transformation into new products and usages.

13 REVISED PCL DAO The Revised Priority Chemical List (PCL) under DENR Administrative Order (DAO) No added twenty (20) specific new chemicals to the twenty eight (28) PCL chemicals (initially selected under DAO No ) based on primary criteria (persistence, bio accumulation and toxicity) and secondary criteria (quantity of importation and use) . With very limited information and tracking of the chemicals in the revised PCL, DAO No (Prescribing Additional Requirements for the Issuance of the PCL Compliance Certificate) was issued for more effective management of regulated chemicals

DAO CCO for Lead and Lead Compounds ◄ Establishes 90 parts per million (ppm) as threshold limit for Lead in paint used as pigment, drying agent or for some intentional use ◄ The use of lead and lead compounds shall be strictly prohibited in the following production/ manufacturing of: - Packaging for food and drink - Fuel additives - Water Pipes - Toys - School supplies - Cosmetics - Paints (as a pigment, a drying agent or for some intentional use) with more than 90ppm threshold limit beyond three (3) years (2013- 2016) for architectural, decorative, household applications and six (6) years ( ) for industrial applications.

27 The Certificate contains post requirements that state on risk management measures to protect human health and environment. Addresses the potential hazards and impacts of PCL chemicals . The Certificate requires compliance with the other applicable policies and procedures based on national laws and international treaties.

SUPPLEMENTAL GUIDELINES FOR THE DENR AO (PRESCRIBING ADDITIONAL REQUIREMENTS FOR THE ISSUANCE OF THE PRIORITY CHEMICAL LIST COMPLIANCE CERTIFICATE)

29 GENERAL RULES Payment of PhP. 500 processing fee per chemical.
15-20 working days processing period . The PCL Compliance Certificate shall be valid for one (1) year. In case of request for change of quantity granted in previously issued PCL Compliance Certificate, the company shall re-apply for registration.

30 SPECIFIC RULES, PROCEDURES
AND REQUIREMENTS This section provides the specific rules, requirements and procedures in the preparation of three (3) basic requirements of DAO No : Chemical Management Plan Contingency Plan, and Monitoring

31 CHEMICAL MANAGEMENT PLAN
The Chemical Management Plan (CMP) shall adequately describe regulated PCL chemical(s) in the operational process and their uses. The importers-distributors, importers-users-manufacturers and users-manufactures shall consider in the CMP the adoption and observance of precautionary health, safety and environmental mitigation measures in accordance with the Safety Data Sheet (SDS) / Safety Data Sheet (SDS), the local safety, health and environmental standards/regulations and the generally accepted practices for the same in both local and international scenes.

32 The importers-distributors, importers-users- manufacturers and users-manufacturers shall ensure that adequate resources (financial and technical) are allocated and provided for the CMP implementation but not limited to the following: Brief Description of the Substance Storage Handling and Transport Use and Disposal Chemical Substitute Plan Safety and Health Requirements Training Program

33 CONTINGENCY AND EMERGENCY PLAN
Any accidental or intentional incidence, occurrence of spillage, leakage, release and other chemical emergencies of the regulated PCL chemicals or their generated wastes shall require immediate corrective action(s) to stop and contain the emergency.

34 MONITORING The EMB Air Quality Monitoring Manual (2004) and Water Quality Monitoring Manual (2008) shall be used for reference whenever applicable by the concerned importer-user- manufacturer and user-manufacturer only to facilitate compliance with the monitoring requirements prescribed under Circular. In addition, the rules and guidelines of the Department of Labor and Employment (DOLE) – Occupational Safety and Health Center (OSHC) and Bureau of Working Conditions (BWC) shall also be referred to.

35 PCL EXEMPTION Exemption from securing a PCL Compliance Certificate or complying with DAO shall be granted to: The importer-distributor, importer-user-manufacturer and user-manufacturer of PCL chemicals covered under the Chemical Control Orders (CCOs), and PCL chemicals that are simply component ingredient(s) of other substances/products with threshold limit cut off of less than or equal to 1% concentration (in mixtures). The industry shall apply for such exemption in compliance with this Memorandum Circular for PCL chemicals subject to evaluation and approval of EMB.

38 CHARACTERISTICS OF HAZARDOUS WASTE
◄ TOXICITY ◄ REACTIVITY ◄ IGNATABILITY ◄ CORROSIVITY Wastes are considered hazardous if they exhibit any of the four characteristics namely TRIC Toxic -when inhaled or ingested or if it penetrates the skin, may involve acute or chronic health risks including carcinogenicity, mutagenicity, or teratogenicity on human or other life forms *TCLP (toxicity characteristic leaching procedure), is a procedure used to simulate the leaching which a waste will undergo if disposed of in a sanitary landfill Reactive -are unstable under normal conditions, react violently with water and create spontaneously explosive mixtures like toxic gases, vapors or fumes and are capable of detonating Ignitable -can create fire under certain conditions Corrosive -whether liquid or solid that causes visible destruction or irreversible alterations in human skin tissue at the site of contact, or a liquid that has a severe corrosion rate on steel or aluminum

48 PENALTY PROVISION Existing and operating industries and related sectors who are found violating the Terms and Conditions of permits and clearances shall be imposed sanctions and fines in accordance with the Graduated Administrative Fines under DENR Memorandum Circular No of DAO 92-29, RA 6969 of Toxic Substances under Title II of RA 6969 and its Implementing Rules and Regulations (DAO 92-29).

MC NO Regional Instructions Registration and Importation Clearance should be issued within the area of jurisdiction. In the absence of PCL (EMB-CO) and CCO (EMB- ROs) permits – outright payment of penalty should be made and no issuance of said permit for the involved/specific shipment. Regulated chemicals are all listed in the PCL and currently subject for revision.
